         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his 22 March 1972 and his 20 July 1979 DD Forms 214 reflect award of the Combat Infantryman Badge.

3. The applicant states that the award was omitted from those forms.

4. The applicant’s military records show he entered on active duty in August 1966 and remained on continuous active duty until his release from active duty in March 1972. He served in various locations throughout the world, to include Fort Dix, New Jersey, Fort Lee, Virginia, Korea, Germany; and in Vietnam as an infantryman with Company A, 1st Battalion, 50th Infantry, 173d Airborne Brigade from July 1969 to January 1970, and thereafter as a Petroleum storage specialist with the 624th Supply and Service Company from January 1970 to September 1970 and with the 15th Administration Company from September 1970 until his return to the United States in December of that year. He was awarded the Combat Infantryman Badge on 1 September 1969. He participated in four campaigns during his tour in Vietnam. The 1st Battalion, 50th Infantry was awarded the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, and the Republic of Vietnam Gallantry Cross with Silver Star, for its actions while the applicant was assigned to that organization. The 624th was awarded the Meritorious Unit Commendation for its actions during the period the applicant was assigned to that unit.

5. The applicant was released from active duty on 22 March 1972 at Fort Ord, California. His DD Form 214 does not show award of the Combat Infantryman Badge, nor the other awards indicated above. Nor does it show that he participated in four campaigns by indicating award of four bronze service stars to the Vietnam Service Medal.

6. An enlistment contract (DD Form 4) shows that the applicant reenlisted in the Army for three years on 19 November 1974. There is no other information concerning his military service until 1977. He reenlisted in the Army for three years on 20 September 1977 and was released from active duty as a result of an approved request for a hardship discharge, on 20 July 1979. This DD Form 214 does not reflect award of the Combat Infantryman Badge. It does show award of the Republic of Vietnam Gallantry Cross Unit Citation with Palm, but as with his 22 March 1972 DD Form 214 fails to show the other awards that he is entitled to.

CONCLUSIONS
:

1. The applicant was awarded the Combat Infantryman Badge. That award should be reflected on his DD Forms 214.

2. The applicant participated in four campaigns during his tour in Vietnam. His DD Forms 214 should show award of the Vietnam Service Medal with four bronze service stars (one for each campaign).

3. The applicant is entitled to award of the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, the Republic of Vietnam Gallantry Cross with Silver Star, and the Meritorious Unit Commendation. Those awards should be shown on his DD Forms 214.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Combat Infantryman Badge, the Vietnam Service Medal with four bronze service stars, the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation, the Republic of Vietnam Gallantry Cross with Silver Star, and the Meritorious Unit Commendation.
