APPLICANT REQUESTS: Revision of his retirement points and all records to reflect his continuous service in the United States Army Reserve (USAR) from 23 August 1988 through 24 September 1990.
SUMMARY OF CREDITABLE RETIREMENT POINTS FOR
APPLICANT STATES: His current statement of retirement points does not show his creditable points or military service beyond 22 August 1988. In support of his claim he submits a copy for award of the Army Achievement Medal, a copy of his Noncommissioned Officer Evaluation Report (NCOER) from August 1989 to February 1990. He also submits several copies of his Leave and Earning Statements (LES) covering: 01-31 November 1988, 01-31 August 1989; 01-31 September 1989;
01-31 November 1989; 01-31 December 1989 and 01-31 January 1990, a copy of his 24 September 1990, USAR discharge orders and a copy of his transfer orders from the USAR Control Group to the 814th MP Company, dated 15 July 1989. He lists the date of discovery of the alleged error or injustice was 5 February 2002. He states that he is attempting to reenlist in the USAR and would like to be as close to retirement as possible.
EVIDENCE OF RECORD: The applicant's military records show:
The applicant’s military records show that he was inducted on 15 July 1969. He was trained as an Infantryman, served in the Republic of Vietnam and was released early to enroll in college. On 10 June 1971, he transferred to the United States Army Reserve (USAR).
On 23 August 1983, the applicant enlisted in the USAR, in pay grade E-5 and he was awarded the Army Achievement Medical with 1st Oak Leaf Cluster for the period of service from 1 March 1986 through December 1988 for meritorious services. On 24 September 1990, he was separated from the USAR with an honorable discharge.
On 21 March 2002, the U.S. Army Reserve Personnel Command responded to the applicant's request for review of his records and the documents he provided. It verified that he was not entitled to any additional retirement points as shown in the summary of creditable retirement points and therefore took no action to correct his record. Between 23 August 1988 and 24 September 1990, the summary shows that he did not earn the required 50 points for each year.

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. These reported drills are insufficient, in and of themselves, to change any of the currently "unsuccessful" years into creditable years (a minimum of 50 points).
2. The summary shows only 21 points for the RYE 22 August 1989. None of the FY89 and FY90 points documented by his LESs would have occurred in that RYE.
3. The reported total of 15 points for the RYE 22 August 1991 combined with 12
of the FY90 points documented by his LESs still equals only 27 points for the RYE.
4. Furthermore the NCOER’s he submitted gives no indication of the level of his participation.
5. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement
6. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
