         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records reflect his foreign service.

3. The applicant states that his DD Form 214 (Certificate of Release or Discharge from Active Duty) does not show his foreign service. He submits copies of his Leave and Earnings Statements (LES) in support of his request.

4. The applicant’s military records show that he enlisted and entered active duty on 23 July 1991. He was separated from active duty in the pay grade of E-4 effective 11 November 1993, on completion of his required active service. His DD Form 214, in block 12f. (Foreign Service) shows "00/00/00."

5. The applicant's LES for the month of August 1992, shows that he received foreign duty pay starting on 18 August 1992. His LES for the month of November 1992, shows that his foreign duty pay was stopped on 24 October 1992 (68 days).

6. Army Regulation 635-5 provides the policy for preparation of separation documents including the DD Form 214. Block 12f. is used to record the total amount of foreign service completed during the period covered by that DD Form 214.

CONCLUSIONS:

1. The applicant's pay records show that he completed 68 days of foreign service and is entitled to have that service shown on his DD Form 214.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

















RECOMMENDATION:

That all of the Department of the Army records related to this case for the individual concerned be corrected by showing in block 12f. of his DD Form 214 the entry "00/02/08."
