         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his report of separation (DD Form 214) be corrected to show that he was released from active duty (REFRAD) on 19 March 1953.

3. The applicant states, in effect, that his DD Form 214 incorrectly shows in item 6, that he was REFRAD on 19 March 1951, when in fact, it was 19 March 1953.

4. The applicant’s military records were destroyed in the 1973 fire at the National Personnel Records Center in St. Louis, Missouri, which destroyed millions of service records. However, the surviving documents show that he was inducted in Indianapolis, Indiana on 20 March 1951.

5. He was transferred to Fort Bragg, North Carolina, to undergo his training. He completed his training and remained at Fort Bragg for the remainder of his service. He underwent a physical examination for separation on 17 March 1953 and was honorably REFRAD on 19 March 1953. He had served 2 years of total active service.

6. However, at the time of his REFRAD, his DD Form 214 was prepared to show that he separated from the service on 19 March 1951.

CONCLUSIONS:

1. The available evidence of record clearly shows that the applicant was inducted on 20 March 1951 and was honorably REFRAD on 19 March 1953, after serving 2 years of active service.

2. However, an administrative error resulted in his DD Form 214 (item 6) incorrectly showing that he was REFRAD on 19 March 1951, 1 day before he entered the service.

3. Accordingly, it would be in the interest of justice to correct his records at this time to show that he was REFRAD on 19 March 1953.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.







RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was REFRAD on 19 March 1953, instead of 19 March 1951, as currently reflected on his DD Form 214, in item 6.
