         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show his service in Southwest Asia (SWA) and eligibility for award of the Southwest Asia Service Medal (SWASM).

3. The applicant states, in effect, that he served in SWA and is entitled to the award. In support of his claim, he provides a copy of his DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 30 April 1992 and a copy of his DA Form 2-1 (Personnel Qualification Record).

4. The applicant’s military records show that he served in the Army National Guard during the period 1 May 1985 to 12 October 1987 and in the Army Reserve Delayed Enlistment Program during the period 13 October to 3 November 1987.

5. On 4 November 1987, he enlisted in the Regular Army, in military occupational specialty 77W (Water Treatment Specialist).

6. On 27 November 1990, a partial order (Orders 229-44) was published by the National Training Center and Fort Irwin, California, which deployed the applicant to an unidentified location effective 30 August 1990.

7. The Desert Shield/Storm Data Base shows that he was deployed to SWA during the periods 1 October 1990 to 15 May 1991 and 1 August to 30 November 1991.

8. On 30 April 1992, he was honorably discharged under Army Regulation 635-200, paragraph 16-5b, voluntary separation of soldiers denied reenlistment. He was paid $1,080.00 (one half separation pay). His DD Form 214 indicates he had a total of 4 years, 9 months and 29 days of creditable service.

9. The Defense Manpower Data Center (DMDC) compiled the Desert Shield/Storm Data Base. The primary Desert Shield/Storm file contains one record for each active duty member who participated in-theater between 2 August 1990 and 31 July 1991, and one record for each Reservist, National Guard member, or retiree who was activated or federalized in response to Desert Shield/Storm. For Reservists and Guard members, the file includes those persons activated or federalized from 2 August 1990 through 31 December 1991. A Phase II file lists active duty personnel who served in-theater between 1 August 1991 and 31 December 1993. There are also separate files covering calendar years 1994 and 1995.


10. Army Regulation 600-8-22 (Military Awards) provides that service in the Persian Gulf War is to be recognized by award of the SWASM to Army members who participated in Operations Desert Shield/Desert Storm in the designated area on or after 2 August 1990. A bronze service star is authorized for the Defense of Saudi Arabia (2 August 1990 to 16 January 1991), the Liberation and Defense of Kuwait (17 January to 11 April 1991), and the Cease-fire Campaign (12 April 1991 to 30 October 1995).

CONCLUSIONS:

1. The evidence of record shows the applicant served in SWA (specific locations are unknown) during the periods 1 October 1990 to 15 May 1991 and 1 August to 30 November 1991. His records should be corrected accordingly.

2. The applicant is entitled to award of the SWASM with 3 bronze service stars for the Defense of Saudi Arabia, the Liberation and Defense of Kuwait and for the Cease-fire Campaign.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the SWASM with 3 bronze service stars for the Defense of Saudi Arabia, the Liberation and Defense of Kuwait and for the Cease-fire Campaign and that item 18 (Remarks) of his DD Form 214, dated 30 April 1992 show he served in SWA during the periods 1 October 1990 to 15 May 1991 and 1 August to 30 November 1991.
