         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests award of the Armed Forces Expeditionary Medal (AFEM).

3. The applicant states that in accordance with MILPER (Military Personnel) Message 96-098 and his DD Form 214 (Certificate of Release or Discharge from Active Duty) and 215 (Correction to DD Form 214) he is eligible for this award. He submits a self-authored letter, dated 7 January 2002, a copy of the MILPER Message 99-100, and copies of his DD Forms 214 and 215 in support of his request.

4. The applicant’s military records were not submitted to the Board. Information herein was obtained from documentation submitted by the applicant.

5. His DD Form 214, as amended, shows he served on active duty from 3 September 1997 to 17 May 1998, a period of 8 months and 15 days.

6. His DD Form 214, as amended, also shows he served in support of Operation Joint Endeavor/Guard and was issued imminent danger pay for the area of Bosnia - Herzegovina from 21 October 1997 to 22 April 1998.

7. His awards include the Army Commendation Medal, the Army Achievement Medal, the Armed Forces Service Medal (AFSM), the Army Reserve Components Achievement Medal (3rd Award), the National Defense Service Medal, the Armed Forces Reserve Medal, the Armed Forces Reserve Medal with “M” Device, the Noncommissioned Officer’s Professional Development Ribbon, the Army Service Ribbon, and the North Atlantic Treaty Organization Medal.

8. His DD Form 215 corrects his imminent danger pay area from Hungary, Croatia.

9. MILPER Message 99-100 provides for award of the AFEM for Operation Joint Endeavor (OJE) and Operation Joint Guard (OJG). The message specifies that designated participation by service members in OJE (from 1 June 1992 to 19 December 1996) and OJG (from 20 December 1996 to 20 June 1998) in the Republic of Bosnia-Herzegovina and Croatia as meeting the requirements for award of the AFEM. The Secretary of Defense approved award of the AFEM in addition to the AFSM to certain participants of OJE and OJG as a one-time exception to the Department of Defense and service policies. The one-time exception is to permit the award of the two medals for the same operation and period of service. The AFEM is limited to only those participants in or those providing direct support to OJE and OJG who were deployed in the countries of Bosnia-Herzegovina and Croatia. To qualify for the AFEM for OJE and OJG service members must be bona fide members of a unit participating for one or more days in OJE or OJG under official orders for 30 consecutive days or 60 nonconsecutive days.
CONCLUSIONS:

1. The evidence of record shows that the applicant served in support of OJE in Herzegovina from 21 October 1997 to 22 April 1998; therefore, he is entitled to correction of his DD Form 214 to show award of the AFEM.

2. The Board also notes that in accordance with pertinent regulations, he is entitled to the AFEM in addition to the AFSM, which has already been awarded, for the same operation and period of service.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by awarding the individual concerned the Armed Forces Expeditionary Medal and showing the award on his DD Form 214.
