         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 be corrected to show that he was awarded the Purple Heart.

3. The applicant states that he was wounded in action in Vietnam, evacuated to Japan, then to Valley Forge Army Hospital, and assigned to Fort Carson, Colorado until his discharge.

4. The applicant’s military records show that he was inducted into the Army on 3 January 1969, trained as an infantryman, and was awarded the Expert Qualification Badge with grenade and machinegun bars, and the Marksman Qualification Badge with rifle bar. In June 1969 the applicant was assigned to Company A, 1st Battalion, 508th Infantry in Vietnam. The applicant was awarded the Combat Infantryman Badge in August 1969, and was promoted to pay grade E-4 in September of that year. On 28 October 1969 he was wounded in action and was awarded the Purple Heart by Headquarters, 3d Brigade, 82nd Airborne Division on 30 October 1969. He was also awarded the Army Commendation Medal for meritorious achievement for the period 15 June 1969 through 27 October 1969.

5. The applicant was evacuated to the 249th Hospital in Japan. The organization to which he was assigned in Vietnam, the 1st Battalion, 508th Infantry, was awarded the Republic of Vietnam Gallantry Cross Unit Citation with Palm for its actions while the applicant was assigned to that organization. He participated in three campaigns and was awarded the Vietnam Service Medal with three bronze service stars.

6. The applicant was assigned to Valley Forge General Hospital as a patient in November 1969, and in March 1970 to Fort Carson, Colorado, where he was released from active duty on 10 December 1970. The applicant had 1 year, 11 months, and 8 days of service. His DD Form 214 does not show award of the Purple Heart.

7. Army Regulation 600-8-22 prescribes the eligibility criteria for award of the Army Good Conduct Medal, and states in pertinent part, that the medal is awarded for exemplary behavior, efficiency, and fidelity in active Federal military service. One of the qualifying periods of service for the award is upon termination of service on or after 27 June 1950, of less than 3 years but more than 1 year (for first award only).

CONCLUSIONS:

1. The applicant was awarded the Purple Heart and that award should be reflected on his DD Form 214.

2. The applicant served his country faithfully and honorably as evidenced by his record. He is entitled to award of the Army Good Conduct Medal.

3. The applicant is entitled to award of the Republic of Vietnam Gallantry Cross Unit Citation with Palm. He was awarded the Expert Qualification Badge with grenade and machinegun bars and the Marksman Qualification Badge with rifle bar. Those awards should be reflected on his DD Form 214.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Purple Heart, the Army Good Conduct Medal, the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the Expert Qualification Badge with grenade and machine gun bars, and the Marksman Qualification Badge with rifle bar.
