         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show he was awarded the Purple Heart.

3. The applicant states that he was injured while serving in Vietnam, during a very early morning rocket attack, which threw him across the room breaking his foot.

4. The applicant’s military records show that he served in the Republic of Vietnam from 6 March 1971 to 6 February 1972.

5. Special Orders 150, dated 27 September 1971, awarded the applicant the Purple Heart for wounds he received in action on 27 March 1971.

6. On 10 February 1972, he was voluntarily released from active duty and transferred to the U.S. Army Ready Reserve. His DD Form 214 (Armed Forces of United States Report of Transfer or Discharge) indicates he was awarded the National Defense Service Medal, the Vietnam Service Medal, the Vietnam Campaign Medal, the Combat Infantryman Badge, and the Parachute Badge.

7. By virtue of his service in Vietnam he is entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm, and 3 bronze service stars on his Vietnam Service Medal reflecting his participation in 3 campaigns (Vietnam Counteroffensive Phase VII, Consolidation I, and Consolidation II).

CONCLUSIONS:

1. The applicant was wounded by hostile fire while serving in Vietnam, and was awarded the Purple Heart.

2. The evidence shows he is entitled to the Republic of Vietnam Gallantry Cross Unit Citation with Palm, and 3 bronze service stars on his Vietnam Service Medal.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by showing the applicant was awarded the Purple Heart for wounds he received on 27 March 1971 while serving in the Republic of Vietnam, and



b. by showing he is entitled to Republic of Vietnam Gallantry Cross Unit Citation with Palm, and 3 bronze service stars on his Vietnam Service Medal.
