         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 (Certificate of Discharge or Release from Active Duty) be corrected to show he was discharged on 31 May 1988, instead of 31 May 1980.

3. The applicant states that he was discharged in 1988 and not 1980, and that the correction will allow him to receive Department of Veterans Affairs (VA) medical care as well as other VA and Social Security benefits. In support of his request he submits a copy of his DD Form 214, and copies of his discharge certificates for 6 October 1986 and 31 May 1988.

4. The applicant’s military records show that on 27 August 1982, he enlisted in the U.S. Army Reserve, and was in the Delayed Entry Program from 27 August 1982 through 8 November 1982. He had no other prior military service.

5. He enlisted in the Regular Army on 9 November 1982, for a period of 4 years. He completed one site unit training at Fort Campbell, Kentucky, served in Germany from October 1984 to November 1987, and was stationed at Fort McClellan, Alabama, and Fort Ord California, from January 1988 to May 1988.

6. The applicant was discharged on 6 October 1986 for the purpose of immediate reenlistment. He reenlisted on 7 October 1986 for a period of 3 years.

7. On 19 April 1988, the applicant requested separation under the provisions of Army Regulation 635-200, chapter 6, for hardship, in order to help his mother care for his ailing grandfather. On 10 May 1988, the applicant’s request was approved.

8. On 23 May 1988, orders were published discharging the applicant with a discharge date of 31 May 1988. However, the applicant’s DD Form 214, indicates he was separated on 31 May 1980, under the provisions of Army Regulation 635-200, chapter 6, for hardship. He had completed 5 years, 6 months and 23 days of active service.

CONCLUSIONS:

1. The applicant’s DD Form 214 incorrectly list his date of separation as 31 May 1980, when evidence shows he was separated on 31 May 1988. Therefore, his records should be changed to correct this error.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.





RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the applicant was separated on 31 May 1988, and not 31 May 1980.
