         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show entitlement to award of the Good Conduct Medal (GCMDL) and the Army Commendation Medal (ARCOM) with 2 oak leaf clusters. In an amendment forwarded through a Member of Congress, dated 27 February 2002, the applicant also requested award of the Republic of Vietnam Gallantry Cross Unit Citation with Palm based on Department of the Army Order 43, dated 1970, inclusion of a letter to his parents be included in his personnel file and that he be provided copies of the general orders for each award of the ARCOM to include the original award. He indicates he doesn’t know where the award originated.

3. The applicant states that they were omitted from his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), dated 25 October 1973. He provides copies of the ARCOM certificates for the first and second oak leaf clusters and orders for the GCMDL.

4. The applicant’s military records show that he enlisted in the Army on 26 October 1970. He completed his required training and was awarded military occupational specialty 76P (Stock Control and Accounting Specialist). He was promoted to pay grade E-5, effective 21 July 1971.

5. During the period 21 August 1971 to 28 March 1972, he served in the 304th Supply and Services Company in Vietnam.

6. General Order Number 1311, 2D Armored Division, Fort Hood, Texas announced the award of the GCMDL for the period 26 October 1970 to 25 October 1973.

7. On 10 May 1976, the Army Decorations Board approved the award of the ARCOM (First and Second Oak Leaf Clusters) for meritorious service, to the applicant for the periods August 1971 to March 1972 and May 1972 to October 1973.

8. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the unit awards received by units serving in Vietnam. This document shows the unit, to which the applicant was assigned, was cited for award of the Republic of Vietnam Gallantry Cross Unit Citation with Palm for the period 1 June 1969 to 31 May 1970 by Department of the Army General Order Number 48, dated 1971.

CONCLUSIONS:

1. The evidence of record clearly shows the applicant was awarded the GCMDL for the period 26 October 1970 to 25 October 1973 and his records should be corrected accordingly.

2. Furthermore, the evidence shows award of the first and second oak leaf clusters to the ARCOM and his records should be corrected accordingly. There is no evidence in the available records of the initial award of the ARCOM; therefore this Board is unable to provide copies to the applicant.

3. The Republic of Vietnam Gallantry Cross Unit Citation with Palm was awarded to the applicant’s unit; however, he was not a member of the unit during the qualifying period and is not entitled to that award.

4. The letter he desires to be included in his personnel file has been incorporated into his Official Military Personnel File and need no further action.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the GCMDL for the period 26 October 1970 to 25 October 1973 and the ARCOM (First and Second Oak Leaf Clusters) for meritorious service, for the periods August 1971 to March 1972 and May 1972 to October 1973, respectively.

2. That so much of the application as is in excess of the foregoing be denied.
