         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the memorandum dated 1 July 1999, Subject: Denied Enrollment be removed from his Official Military Personnel File (OMPF).

3. The applicant states that since the date the memorandum was issued he graduated from the Advanced Noncommissioned Officer Course (ANCOC).

4. The applicant’s military records show that he enlisted in the Regular Army on 21 June 1985. He was promoted to Sergeant First Class, E-7, effective 1 March 1999 conditional upon his successfully completing ANCOC.

5. By memorandum, Regimental NCO Academy, Fort Gordon, GA dated 1 July 1999, the applicant was denied enrollment in ANCOC for not meeting the body fat composition standards upon arrival at the school.

6. The applicant returned to ANCOC on 19 October 2000 and graduated on 20 March 2001 as the Distinguished Graduate.

7. Army Regulation 600-8-104 states that letters of failure to complete an Army service school resident course of instruction will be filed on the performance fiche of the OMPF.

CONCLUSIONS:

1. The memorandum denying the applicant enrollment in ANCOC in 1999 was properly filed on the performance fiche of his OMPF; however, there is no longer any purpose for its remaining on his performance fiche. A year after he was denied enrollment he re-attended and successfully completed the course, as the Distinguished Graduate. It should no longer be a matter of interest to promotion or other selection boards that he was denied enrollment at one time.

2. While the historical record of the applicant having received the memorandum should be maintained and it would not be appropriate to remove this memorandum from his OMPF, as a matter of equity it would be appropriate to move it from his performance fiche to his restricted fiche.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by moving the memorandum dated 1 July 1999 denying the applicant enrollment in ANCOC from his performance fiche to his restricted fiche.


2. That so much of the application as is in excess of the foregoing be denied.
