PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 21 May 2002
         DOCKET NUMBER: AR2001065991

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Ms. Rosa M. Chandler Analyst

The following members, a quorum, were present:

Ms. Jennifer L. Prater Chairperson
Ms. Barbara J. Ellis Member
Mr. Thomas Lanyi Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) be changed to reflect his correct social security account number (SSAN) in Item 32 (Remarks), and that his military occupational specialty (MOS) be corrected in Item 25a (Specialty Number and Title).

3. The applicant states that the last two digits of his SSAN should be "43" and not "34" as reflected on his DD Form 214. He also states that his specialty was MOS 131.60 (Tank Driver) and not MOS 131.10 (Armored Crewman). In support of his request, he submits his DD Form 214 and his DD Form 93 (Record of Emergency Data).

4. The available evidence shows that the applicant was inducted into the Army of the United States on 24 February 1959. His DA Form 20 (Enlisted Qualification Record) shows that he was awarded MOS 131.10 (Armored Crewman) on 1 January 1960 and that he served in this MOS the entire time that he was in an active duty status.

5. The applicant's service number is widely used throughout his official military personnel file (OMPF). His DD Form 93 (Record of Emergency Data) is the only document in his OMP that contains his SSAN. This document shows that the last two digits of his SSAN are "43." The date of the last entry on this record is 24 February 1959.

6. On 13 February 1961, the applicant was honorably released and transferred to the United States Army Reserve. His DD Form 214 appropriately shows that he was awarded MOS 131.10 (Armored Crewman). His SSAN shows the last two digits as "34."

CONCLUSIONS:

1. The is no evidence in the applicant's records to show that he was a tank driver (MOS 131.60). There is overwhelming evidence to show that he was trained as an armored crewman (MOS 131.10). He may have performed the duties of a tank driver, but he was never given that MOS.

2. From the available evidence, the Board concludes that the applicant's SSAN was incorrectly entered in Item 32 (Remarks) on his DD Form 214. The correct SSAN should be "XXX-XX-XX43," not "XXX-XX-XX34."

3. In view of the foregoing, the applicant’s records should be corrected, but only, as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215 (Correction to DD Form 214) to show in Item 32 on his DD Form 214 of 13 February 1961 that his correct SSAN is "XXX-XX-XX43."

2. That so much of the application as is in excess of the foregoing be denied.

The applicant states the SSN shown on his DD Form 214 is incorrect; the last two digits are reversed. His DD Form 47 (Record of Induction), dated 8 February 1968, shows his SSN with the last two digits as 43. It would be appropriate at this time to correct his DD Form 214 to show his SSN as it is shown on his DD Form 47.

The evidence of record shows that upon entry on active duty in the U.S. Army the applicant's SSN was recorded in his personnel records as "XXX-XX-XX53."
