         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests award of the Good Conduct Medal, the Expert Infantryman Badge, and any others he is entitled to.

3. The applicant states that his DD Form 214 (Report of Transfer or Discharge) is missing several medals. He provides no documentation in support of his request.

4. The applicant’s military records show that he was inducted and entered active duty on 16 November 1967. He completed infantry training and was assigned to Korea. His DA Form 20 (Qualification Record) shows that he was assigned as a cannoneer and prime mover driver with the 79th Artillery during his service in Korea.

5. He was separated from active duty in the pay grade of E-4 on 8 July 1969. His authorized awards listed on his DD Form 214 are the National Defense Service Medal, the Armed Forces Expeditionary Medal, and the Marksmanship Badge with rifle bar. Neither the Good Conduct Medal nor the Expert Infantryman Badge are shown as authorized awards. There is no documentation in the available record to show that he was recommended for or awarded any additional awards.

6. Army Regulation 600-8-22 provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service.

7. Army Regulation 600-8-22 also provides that the Expert Infantryman Badge (EIB) is awarded to qualified Infantry and Special Forces soldiers who complete a special EIB program and successfully pass the EIB test.

8. A review of the applicant’s records provided no evidence of misconduct or lost time during his period of active duty.

CONCLUSIONS
:

1. The evidence of record indicates that he was qualified for an award of the Good Conduct Medal. It would now be fair and just to award the applicant the Good Conduct Medal.

2. There is no evidence of record, or evidence provided by the applicant, to show that he completed any EIB program that would lead to award of the Expert Infantryman Badge.


3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case for the individual concerned be corrected by showing that he was awarded the Good Conduct Medal for the period 16 November 1967 through 8 July 1969.

2. That so much of the application as is in excess of the foregoing be denied.
