         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her report of separation (WD AGO Form 53-98) be corrected to reflect that she was separated in the rank of major.

3. The applicant states, in effect, that she was serving in the rank of major on 19 August 1948, when she was honorably released from active duty; however, her WD AGO Form 53-98 shows that she was released in the rank of captain.

4. The applicant’s military records show that she was commissioned as a second lieutenant on 31 August 1942 and entered active duty as a nurse. She was promoted to the rank of captain on 14 May 1945 and to the rank of major on 1 October 1947. She was honorably released from active duty (REFRAD) on 19 August 1948 and was transferred to the Officer Reserve Corps (now known as the United States Army Reserve (USAR)). At the time of her REFRAD, her WD AGO Form 53-98 reflected her rank as captain. She remained in the USAR in an active status until she was transferred to the USAR Control Group (Retired) in the rank of major on 17 October 1963.

CONCLUSIONS:

1. It appears that an administrative error resulted in her report of separation incorrectly reflecting her rank as a captain instead of a major, accordingly, it would be in the interest of justice to correct her records to show that she was serving in the rank of major at the time of her REFRAD on 19 August 1948.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was REFRAD on 19 August 1948 in the rank of major.
