         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his date of birth on his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to read 31 December 1957.

3. The applicant states that his date of birth is 31 December 1957 and not
27 February 1963 as reflected on his DD Form 214. In support of his request the applicant submits a notarized copy of his birth certificate, which shows his date of birth as 31 December 1957.

4. The applicant’s military records show that he enlisted in the Regular Army on 14 November 1978, for a period of 3 years. His enlistment/reenlistment contracts and his initial entrance medical examination reflect his date of birth as
31 December 1957.

CONCLUSIONS:

1. The applicant’s military records and his notarized birth certificate show his date of birth as 31 December 1957, and as such his DD Form 214 should be corrected to reflect this date.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by changing the applicant’s DD Form 214, item 5 (Date of Birth) from 27 February 1963 to 31 December 1957.
