         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show a second award of the Army Superior Unit Award (ASUA).

3. The applicant states that his second award of the ASUA was authorized retroactively after his retirement. In support of his application, he submits a copy of his DD Form 214; a copy of a DD Form 215 (Correction to DD Form 214), dated 23 October 2000; a Memorandum, dated 18 June 2001; a Memorandum, dated 16 January 2001; and an award certificate and citation for the ASUA for the period 1 October 1999 to 1 October 2000.

4. The applicant’s military records show that he completed over 30 years of active duty on 31 August 2000 when he retired in the rank of colonel.

5. The applicant’s retirement DD Form 214 shows one award of the ASUA as an authorized award.

6. The applicant’s Officer Record Brief, prepared on 2 March 2000, shows one award of the ASUA.

7. The applicant provided a copy of a Memorandum, dated 18 June 2001. This Memorandum states that the ASUA was presented to the U.S. Army Yuma Proving Ground, that the applicant was permanently assigned to Yuma Proving Ground during the recognized period (1 October 1999 to 1 October 2000) and that he was authorized to receive the ASUA on a permanent basis. This Memorandum also states that to ensure his official military personnel file and DD Form 214 are updated to reflect receipt of the ASUA, he must complete a DD Form 149 (Application for Correction of Military Record). The applicant also provided a copy of an award certificate and citation for the ASUA.

8. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Army Superior Unit Award was created in 1985 to recognize outstanding meritorious performance by a unit in completing a difficult and challenging mission under extraordinary circumstances during peacetime. Circumstances may be deemed to be extraordinary when they do not represent the typical day-to-day circumstances under which the unit normally performs, or may reasonably be expected to perform, its peacetime mission.

CONCLUSIONS:

1. The applicant’s retirement DD Form 214 shows one award of the ASUA.

2. The applicant’s Officer Record Brief, prepared on 2 March 2000, shows entitlement to one award of the ASUA. Evidence of record shows the applicant was awarded the ASUA on 16 January 2001. Therefore, the applicant is entitled to correction of his DD Form 214 to show two awards of the ASUA.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded two awards of the Army Superior Unit Award.
