         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her DD From 214 (Certificate of Release or Discharge from Active Duty) be corrected to show in item 23 (Type of Separation) “Retirement” instead of “Discharge.” The applicant states that the error was brought to her attention at the Bamberg Transition Center in Germany.

3. The applicant’s military records show that she was retired under the provisions of Army Regulation 635-200, chapter 12, for sufficient service for retirement. The applicant’s DD Form 214 indicates she had 20 years and 8 days of active military service.

4. Army Regulation 635-5, provides in pertinent part that item 23 of the DD Form 214 should contain the type of separation (i.e. Retirement, Discharge, Release from ADT, etc.) from the member’s separation approval papers. The applicant’s separation orders 081-003, dated 22 March 2001, authorized the applicant’s retirement effective 30 June 2001, with placement on the retired list on 1 July 2001.

CONCLUSIONS:

1. The applicant was retired on 30 June 2001, under the provisions of Army Regulation 635-200, chapter 12, therefore her DD Form 214, item 23 (Type of Separation) should read “Retirement” instead of “Discharge.”

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by changing the applicant’s DD Form 214, item 23 to show “Retirement,” instead of Discharge.
