         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected to show the Army Superior Unit Award.

3. The applicant states that the Army Superior Unit Award is not shown on her DD Form 214. In support of her application, she submits a copy of her DD Form 214, a copy of her assignment orders, and a copy of Total Army Personnel Command (PERSCOM) Message Number 090946, dated 2 May 2001.

4. The applicant’s military records show that she enlisted on 30 January 1992, as a counter intelligence agent and continued to serve until she was honorably discharged on 3 September 2001. The applicant’s DD Form 214 (Certificate of Release or Discharge from Active Duty) does not show the Army Superior Unit Award.

5. The applicant provided a copy of PERSCOM Message Number 090946, dated 2 May 2001, awarding the 3rd Brigade, 2nd Infantry Division the Army Superior Unit Award for the period 16 September to 1 October 2000. The applicant provided a copy of her assignment orders which shows that she was assigned to the 3rd Brigade, 2nd Infantry Division.

CONCLUSIONS:

1. The applicant’s unit was awarded the Army Superior Unit Award for the period 16 September to 1 October 2000. Therefore, she is entitled to correction of her records to show this award.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case for the individual concerned be corrected by showing that she was awarded the Army Superior Unit Award.
