         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his discharge certificate be corrected to show pay grade E-5.

3. The applicant states, in effect, that the pay grade of E4 on his discharge certificate dated 9 April 1973, does not correspond with the pay grade of E5 on his report of discharge (DD Form 214).

4. The applicant's military records were destroyed in the 1973 fire at the National Personnel Records Center in St. Louis, Missouri which destroyed millions of service records.

5. The available records show that the applicant enlisted on 10 April 1967. He was released from active duty on 11 November 1969, with 2 years, 7 months, and 2 days total active service.

6. The applicant’s DD Form 214 shows he was released from active duty in the pay grade of E5.

7. The available records show that the applicant requested a copy of his discharge certificate on 14 February 1994, stating he had never received one. An honorable discharge certificate was issued to the applicant in the pay grade of E4.

8. On the report for reassignment gains and separations at Fort Lewis, Washington transfer point for the date of 11 November 1969, the applicant is listed with a pay grade of E5.

CONCLUSIONS:

1. The DD Form 214 and the separation report from the Fort Lewis, Washington transfer point confirm the applicant was in the pay grade of E5 at the time of release from active duty.

2. There is nothing to the contrary to dispute that the applicant’s discharge certificate should be corrected.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.




RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by issuing the applicant with an honorable discharge certificate in the pay grade of E5.
