         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that he be paid a 1.5B Selective Reenlistment Bonus (SRB) in conjunction with his reenlistment on 31 July 2001.

3. The applicant states that his reenlistment contract, dated 31 July 2001, shows he was given a 0.5B SRB for military occupational specialty (MOS) 31C. He states that he should have been given a Targeted Selective Reenlistment Bonus (TSRB) of “1.5B, MOS 31C W/"P" Fort Bragg.” In support of his application, he submits a copy of his Enlistment/Reenlistment Document dated 31 July 2001, his DA Form 4789 (Statement of Entitlement to Selective Reenlistment Bonus), an EPQ3 Personnel Query, and a SRB/TSRB Message 01-14C, dated 6 July 2001.

4. The applicant’s military records show that he initially served in the Regular Army from October 1985 to July 1988. He served as a commissioned officer in the Pennsylvania Army National Guard from January 1990 until he resigned his commission on 8 May 1995. The applicant is currently serving on active duty in the rank of staff sergeant.

5. The applicant enlisted in the Regular Army on 9 June 1995 for a period of three years in pay grade E-4.

6. He reenlisted on 8 December 1997 for a period of two years in pay grade E-5 without bonus entitlement.

7. He reenlisted again on 24 September 1998 for two years in pay grade E-5 without bonus entitlement.

8. The applicant reenlisted again on 31 July 2001 for six years in pay grade E-5. At the time of his reenlistment, he had completed 9 years, 3 months, and 2 days total active military service. Item 8b (Remarks) of his Enlistment/Reenlistment Document (DD Form 4/1) indicates that he was entitled to a 0.5B SRB in MOS 31C (Single Channel Radio Operator). The applicant elected 50% payment of his SRB.

9. The applicant provided a copy of SRB/TSRB Message Number 01-14C, dated 6 July 2001, which states that soldiers in the grade of sergeant in MOS 31C with a special qualification identifier (SQI) of “P” (Parachutist) were entitled to a 1.5B SRB.

10. In the processing of this case, an advisory opinion was requested from the Chief of the Retention Management Division, U.S. Total Army Personnel Command. In response, the Chief of the Retention Management Division prepared a memorandum to the local retention office at Fort Bragg. This memorandum directed that the local retention office produce a corrected copy of the applicant’s DD Form 4/1 changing item 8b(2) to read “SRB 1.5B, MOS 31C w/"P" Fort Bragg” and to produce a DA Form 4789. This memorandum also points out that a review of the facts surrounding the applicant’s reenlistment of 12 April 2001 [sic] shows that he was entitled to an existing reenlistment bonus if he remained at Fort Bragg, North Carolina, and was assigned to an airborne position.

11. The applicant was provided a copy of the memorandum for information and an opportunity to respond. As of this date, he has not provided any comments.

12. Army Regulation 601-280 sets forth the basic authority for the Army Enlistment Program for all military personnel of the Active Army. This regulation prescribes the eligibility criteria and options currently available in the Army Reenlistment Program. Chapter 5 pertains to the Enlistment and Reenlistment Bonuses for Enlisted Personnel. Paragraph 5-5, states that the Selective Reenlistment Bonus (SRB) Program is a monetary incentive offered to qualified soldiers who reenlist in the Regular Army for continued duty in certain MOSs. The SRB is designed to increase the number of reenlistments in critical MOSs and is paid by specialty and grade within established zones. The three zones are:

         (1) Zone A – reenlistment between 21 months and six years of active service.

         (2) Zone B – reenlistment between six to 10 years of active service.

         (3) Zone C – reenlistment from 10 to 14 years of active service (Zone C Bonuses have not been applied since 31 Jan 86.)

CONCLUSIONS:

1. The applicant reenlisted on 31 July 2001 in the rank of sergeant. His reenlistment contract shows he was authorized a 0.5B SRB in MOS 31C.

2. The message, in effect at the time, indicated that soldiers in the rank of sergeant were authorized to receive a 1.5B SRB in MOS 31C with SQI “P” at Fort Bragg, North Carolina.

3. Based on the instructions provided by the Chief of the Retention Management Division, the applicant is entitled to correction of item 8b(2) of his Enlistment/Reenlistment Document (DD Form 4/1) dated 31 July 2001, to show “1.5B SRB, MOS 31C w/“P”, Fort Bragg.”

4. Based on paragraph 3, above, the applicant is also entitled to payment based on a 1.5B SRB effective 31 July 2001.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was eligible for and was authorized a 1.5B SRB at the time of his reenlistment on 31 July 2001.

2. That the applicant be paid the difference between a 0.5B SRB and 1.5B SRB effective 31 July 2001 and that any future payment of SRB be made at the 1.5 SRB level.
