2. The applicant requests, in effect, that he be considered by a Special Selection Board (SSB) for promotion to Chaplain colonel (COL) under 2000 and 2001 promotion board criteria.
3. The applicant states, in effect, that the 2000 and 2001 promotion boards viewed his record when it contained an erroneous Officer Evaluation Report (OER) which has since been removed from the record by the Army Board for Correction of Military Records. He feels that this erroneous OER may have unjustly influenced the boards resulting in his non-selection for promotion to COL.
4. The applicant’s military records show that he, a Regular Army Chaplain lieutenant colonel (LTC), was eligible for promotion consideration and was considered for promotion by the 2000 and 2001 Fiscal Year (FY) COL – Chaplain Promotion Selection Boards but was not selected for promotion.
5. He was commissioned as a United States Army Reserve (USAR) second lieutenant in the Adjutant General Corps (AGC) on 3 June 1973. He served on active duty during his officer basic course and then was ordered on active duty on 26 June 1974. He was released from active duty on 31 July 1977 and transferred to a USAR Troop Program Unit. On 21 August 1980, he was promoted to captain (CPT) with a date of rank (DOR) of 24 March 1980.
On 11 March 1984, he was ordained a minister of the gospel. He applied for appointment as a Chaplain and was appointed as a USAR Chaplain (CPT) on
24 May 1985. He was ordered on active duty on 17 June 1985. He was promoted to major on 1 October 1988 and to LTC on 1 January 1996.

He has a masters degree in divinity and has completed the AGC Advanced Course, the Chaplain Advanced Course, the Combined Arms and Services Staff School (CAS3), the Command and General Staff College, and the Division Chaplain Course. He has received the following awards: Bronze Star Medal for meritorious service in the 1st Cavalry Division during Desert Shield and Desert Storm; 4 awards of the Meritorious Service Medal; 4 awards of the Army Commendation Medal; and 2 awards of the Army Achievement Medal. He has had three overseas tours. As a Chaplain, he has served at brigade, division, corps, Army, and installation level.
7. As a LTC, he has received 2 above center-of-mass (ACOM) OERs and
4 center-of-mass (COM) OERs. As a MAJ, he had 3 ACOM and 6 COM OERs. All recommended promotion ahead of his contemporaries.
8. A LTC COM OER, for the period 3 June 1995 to 14 April 1996, that recommended promotion with contemporaries was found by this Board, on
28 August 2001, to have been given in error and was removed from the applicant’s file on 1 October 2001. It is this OER that the applicant feels may have prevented him from being selected for promotion. The period of this OER was declared non-rated and its removal was declared to not be considered prejudicial to any future personnel actions.
CONCLUSIONS:
1. Since the LTC COM OER that recommended promotion with his peers has been removed from his record and considering the applicant’s evaluation record, awards, civilian and military education, and the variety of duty assignments and levels of responsibilities in which he has served, the applicant’s file is competitive for consideration for promotion to Chaplain (COL) and should be reconsidered for that promotion by a SSB under the criteria for both the 2000 and the 2001 FY COL – Chaplain Promotion Selection Boards.
2. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION:
That all of the Department of the Army records related to this case be corrected for the individual concerned by reconsidering him for promotion to Chaplain (COL) by a SSB under the criteria for both the 2000 and the 2001 FY COL – Chaplain Promotion Selection Boards.
