         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that he be awarded the Vietnam Service Medal (VSM), the Marksmanship Medal (MKM) and the Air Medal (AM) with 5th oak leaf cluster (OLC).

3. The applicant states that the foregoing awards were omitted from his DD Form 214, Report of Transfer or Discharge. In support of his request, he provides a copy of the general orders and his citation for the AM with 5th OLC.

4. The applicant’s military records show that he was inducted on 24 June 1965, and served in Vietnam with Air Troop, 11th Armored Cavalry Regiment, from 3 January 1967 to 16 June 1967. He separated from active duty to the US Army Reserve in pay grade E-5 on 22 June 1967.

5. His DD Form 214 reflects that he was awarded the National Defense Service Medal (NDSM).

6. His DA Form 20, Enlisted Qualification Record, shows that he was also awarded the MKM with rifle bar (M-14), the Aircraft Crewman Badge (now the Aircraft Crew Member Badge) and the VSM. The record also shows that during his approximately 2 year period of active duty, he attained the grade of E-5 and his conduct and efficiency were consistently rated as excellent.

7. Department of the Army General Order Number 8, dated 1974, awarded all personnel assigned to the United States Army Vietnam from 8 February 1962 through 28 March 1973 the Republic of Vietnam Gallantry Cross Unit Citation with Palm.

8. Army Regulation 600-8-22, Military Awards, provides, in pertinent part, that the Good Conduct Medal is awarded on a selective basis to soldiers who distinguish themselves from among their fellow soldiers by their exemplary conduct, efficiency and fidelity throughout a specified period of continuous enlisted active Federal military service. For first award only, upon termination of service on or after 27 June 1950 of less than 3 years but more than 1 year.

CONCLUSIONS:

1. The evidence of record and the general orders provided by the applicant show that he is entitled to have the following awards reflected on his DD Form 214, in addition to the NDSM, which is already there: the MKM with rifle bar, the Aircraft Crew Member Badge, the VSM, the Republic of Vietnam Gallantry Cross Unit Citation with Palm and the AM with 5th OLC.

2. Furthermore, since he was promoted to the grade of E-5 in just under 2 years of active service between 24 June 1965 and 22 June 1967, and his conduct and efficiency were always rated as excellent during this period, it appears that he meets the criteria for award of the Good Conduct Medal. It would, therefore be appropriate to also include this award on his DD Form 214.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned is entitled to have the MKM with rifle bar, the Aircraft Crew Member Badge, the VSM, the Republic of Vietnam Gallantry Cross Unit Citation with Palm, the AM with 5th OLC and the Good Conduct Medal for the period 24 June 1965 to 22 June 1967, added to his DD Form 214.
