         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected by showing entitlement to award of the Purple Heart (PH).

3. The applicant states that he was wounded on 27 November 1950, in North Korea. He provides a copy of his Honorable Discharge Certificate (HDC).

4. The applicant’s military records show that he entered on active duty on 26 May 1948, in the rank of corporal. On 18 June 1951, he was promoted to sergeant first class. He was separated with an honorable discharge on 26 April 1952.

5. Item 29 of his discharge document (Wounds received as a result of action with enemy forces) shows he received shrapnel wounds to the right thigh, on 27 November 1950, in Korea.

6. Office of the Surgeon General records show the applicant was admitted to a medical treatment facility on 28 November 1950 with the diagnosis of “Wound, penetrating, missile with no nerve or artery involvement” of the thigh, received in action.

CONCLUSIONS:

1. The evidence of record clearly shows the applicant was wounded in action in Korea and treated by a medical facility; therefore, he is entitled to award of the PH for wounds received as a result of enemy action on 27 November 1950, while serving in Korea.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned is awarded the PH for wounds received as a result of enemy action on 27 November 1950, while serving in Korea.
