         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that the Armed Forces Expeditionary Medal (AFEM) and Korean Service Medal (KSM) be added to his records.

3. The applicant states, in effect, that he served in the Army from 1966 to 1968 and supported a military conflict in Southeast Asia while assigned to Korea. In support of his application, he submits a copy of his separation document
(DD Form 214), dated 23 January 1968.

4. The applicant’s military records show that on 23 January 1968, he was honorably released from active duty (REFRAD) at the expiration of his term of service (ETS). At the time of his separation he had completed a total of 1 year,
9 months, and 6 days of active military service.

5. The applicant’s Enlisted Personnel Qualification Record (DA Form 20) shows that he was trained and served in military occupational specialty (MOS) 05C (Radio Teletype Operator) and that the highest rank he attained while serving on active duty was specialist four/E-4 (SP4). This record also confirms that he served in Korea from 17 December 1966 to 19 January 1968.

6. The DD Form 214, issued to and authenticated by the applicant with his signature on the date of his separation, confirms that he was honorably released from active duty on 23 January 1968 and was transferred to the Army Reserve. It also shows that he was credited with completing 1 year, 1 month, and 6 days of foreign service in the United States Army Pacific (USARPAC) and that during his active duty tenure, he earned the National Defense Service Medal and the Sharpshooter Badge-Rifle. No other awards are listed in his separation document.

7. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual military awards. Paragraph 2-12 contains guidance on awarding the AFEM and it states, in pertinent part, that it will be awarded for service in Korea between 1 October 1966 and 30 June 1974. Paragraph 5-8 of the awards regulation provides for award of the KSM and it states, in pertinent part, that it is awarded for qualifying service in the theater of operations between 27 June 1950 and 27 July 1954.

CONCLUSIONS:

1. The evidence of record confirms that the applicant served in Korea from
17 December 1966 to 19 January 1968. Based on this service he clearly meets the criteria for award of the AFEM and the Board concludes it would be appropriate to add this award to his record at this time.


2. However, by regulation, the qualifying period for award of the KSM is 27 June 1950 and 27 July 1954. This authorized period clearly expired prior to the applicant’s service in Korea and therefore, the Board concludes he is not entitled to receive this award.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case for the individual concerned be corrected by showing that he earned the Armed Forces Expeditionary Medal for his service in Korea; and by providing him a corrected separation document that includes this award.

2. That so much of the application as is in excess of the foregoing be denied.
