         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that item 38 of his Enlisted Qualification Record, DA Form 20, be corrected to show he was assigned to Company L, 187th Airborne Regimental Combat Team (ARCT) in Japan on 15 June 1953.

3. The applicant states that he was never in Company L, 15th ARCT and he does not believe there ever was a 15th ARCT. He left Company L, 15th Infantry Regiment and transferred to Company L, 187th ARCT in Japan. He provides Special Orders 228, Headquarters, 187th Regimental Combat Team showing he was reassigned from Company L, 187th AIR in September 1953.

4. The applicant’s military records show that he enlisted in the Regular Army on 7 January 1952. His DA Form 20 shows he was assigned to Company L, 15th Infantry Regiment, Korea on 16 November 1952. It shows he was reassigned to Company L, 15th ARCT, Japan on 15 June 1953. He had continuous active service. He signed a retyped DA Form 20 on 12 April 1969 and last reviewed his DA Form 20 on 8 September 1971. He retired on 1 February 1972.

5. A morning report entry for Company L, 187th Abn (Airborne) RCT, Japan shows he was an assigned gain on 18 June 1953.

CONCLUSIONS:

1. There appears to be a typographical error on the applicant’s DA Form 20, item 38 for the entry beginning 15 June 1953. The error was most likely made by the clerk who retyped the form by carrying over a portion of the previous entry. The error was not caught when the applicant signed the retyped form in April 1969 nor when he reviewed it in September 1971. Morning report entries for Company L, 187th ARCT verify that he was assigned to that unit on 18 June 1953 (not 15 June 1953).

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That the applicant’s DA Form 20, item 38, entry beginning 15 June 1953 be corrected to read “18Jun53/11B2S/Lt Wpns Infmn/Co L 187th Abn RCT/EXC/EXC/PCS.”


2. That so much of the application as is in excess of the foregoing be denied.
