         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, correction of item 18 (Remarks) of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show that he served in the Reserve Officers Training Corps (ROTC)/Simultaneous Membership Program (SMP).

3. The applicant states that he is not a United States Military Academy (USMA) graduate, nor has he ever attended the USMA. In support of his application, he submits a copy of his DD Form 214, a copy of his DA Form 1506 (Statement of Service – For Computation of Length of Service for Pay Purposes), dated 3 November 1997, and a copy of his Bachelor of Arts degree from the State University of New York, dated 14 May 1988.

4. The applicant’s military records show he was enrolled in the ROTC/SMP from 15 September 1986 to 13 May 1988, and served in the US Army Reserve (USAR) not on active duty from 14 May to 2 June 1988.

5. He served as a USAR officer on active duty from 3 June 1988 to 4 July 1989. He was reappointed in the Regular Army on 5 July 1989 and continued to serve until he was honorably separated on 1 August 2000.

6. Item 18 (Remarks) of the applicant’s DD Form 214 shows the entry “Block 12c includes service as a USMA Cadet from 19860915 to 19880603” (15 September 1986 to 3 June 1988).

7. The applicant provided a copy of his Bachelor of Arts degree from the State University of New York, dated 14 May 1988, which shows that he did not attend the USMA.

8. The applicant’s DA Form 1506 shows that he was credited with ROTC/SMP service from 15 September 1986 through 13 May 1988.

9. Army Regulation 635-5 establishes the policies and procedures for completion and distribution of the DD Form 214. In pertinent part, it states that item 18 (Remarks) is used for entries required by Headquarters Department of the Army for which a separate block is not available, and as a continuation for entries in item 11, 13, and 14.

CONCLUSIONS:

1. The Board notes the applicant’s contention that he is not a USMA graduate, nor had he ever attended the USMA. Evidence of record shows that he completed his Bachelor of Arts degree from the State University of New York on 14 May 1988, which is evidence that he did not attend the USMA. Therefore, the entry “USMA CADET” should be deleted from item 18 (Remarks) of his DD Form 214.
2. The evidence of record shows that the applicant was credited with ROTC/SMP service from 15 September 1986 to 13 May 1988, and served in the USAR not on active duty from 14 May to 2 June 1988. Therefore, the entry “USMA CADET” should be replaced with “ROTC/SMP” in item 18 (Remarks) of the applicant’s DD Form 214.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case for the individual concerned be corrected:

a. by deleting the entry “USMA CADET” in item 18 (Remarks) of his DD Form 214; and,

b. by showing the entry “ROTC/SMP” in item 18 (Remarks) of his DD Form 214.
