APPLICANT REQUESTS: That he be awarded the Purple Heart.
APPLICANT STATES: That he was wounded during combat in July or August 1950 by gunshot or shrapnel that entered his right hip and is still in his hip. It happened near Taegu, South Korea. He was not treated at a hospital; he just kept going with the invasion. He does not know if the company clerk reported it or not. The only witness who could have supported him was killed in action.
COUNSEL CONTENDS: Counsel requests that, if there is anything that can be done to assist the applicant, that it be done.
EVIDENCE OF RECORD: The applicant's military records were lost or destroyed in the National Personnel Records Center fire in 1973. Information contained herein was obtained from alternate sources.
After having had prior service, the applicant reenlisted in the Army on 15 November 1948. He served in Korea and his awards and decorations include the Korean Service Medal with three bronze service stars and the Presidential Unit Citation. He apparently served with the 25th Signal Company, 25th Infantry Division. He separated on 19 May 1952.
Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for a wound sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.
The historical files of the 25th Signal Company, 25th Infantry Division were reviewed at the National Archives, College Park, MD. The review failed to identify the applicant as being wounded in action. A review of the War Diary of the 25th Signal Company for the months of July and August 1950 revealed that wounded in action and killed in action were regular parts of the Diary but no one was listed as killed or wounded in those months.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. The Board appreciates the applicant’s service in Korea but there is insufficient evidence to show that he met the eligibility criteria for award of the Purple Heart.
2. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
