APPLICANT REQUESTS: Reconsideration of his request for award of the Purple Heart.
APPLICANT STATES: That he was a prisoner of war and was wounded by shrapnel after he was captured by the German Army on 17 December 1944. His Separation Qualification Record, WD AGO Form 100, shows that he received shrapnel wounds after being captured. He is service-connected for scars.
NEW EVIDENCE OR INFORMATION: Incorporated herein by reference are military records which were summarized in a memorandum prepared to reflect the Board's original consideration of his case on 7 June 2001 (docket number AR2001051881).
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. The Board notes that the WD AGO Form 100 reflects that he was wounded by shrapnel. However, without substantiating evidence, such as contemporaneous VA documentation showing he is service-connected for scars resulting from shrapnel or shrapnel-like injuries, the Board believes that the overall merits of the case, including the latest arguments, are insufficient as a basis for the Board to reverse its previous decision.
2. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
