         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his records to show award of the Navy Presidential Unit Citation for participation in the Inchon Invasion during the period 15 September 1950 through 11 October 1950 and to show an additional bronze service star for his service in Korea.

3. The applicant states that he is entitled to an additional battle star for his service in Korea and that his records should be updated to reflect that he is authorized the Presidential Unit Citation awarded by the Secretary of the Navy for participation in the Inchon Invasion during the period 15 September 1950 through 11 October 1950. In support of his application, he submits a supplemental letter, two DD Forms 214 (Report of Separation from the Armed Forces of the United States), three cover sheets, orders awarding him the Combat Infantryman Badge, a citation for award of the Presidential Unit Citation, a Unit Journal for the Special Activities Group, a cite from the U.S. Army Center of Military History, information paper on the General Headquarters, 1st Raider Company, a letter from the National Archives and Records Administration, a list of papers, and a copy of an outgoing message from the Far East Command in Japan.

4. The applicant’s military records show that he initially served in the Florida National Guard from 17 November 1947 through 16 September 1948. He enlisted in the Regular Army on 17 September 1948, completed infantry training and served in Korea from 12 September 1950 through 4 April 1951. The applicant was honorably discharged from active duty on 16 September 1952. The applicant also served in the Air Force from 6 August 1956 to 31 August 1972.

5. The applicant’s DD Form 214, which covers his service in the Army, does not show the Navy Presidential Unit Citation as an authorized award.

6. The applicant’s DA Form 20 (Qualification Record-Enlisted Personnel) shows he served as an athletic instructor with Company D, Staff Battalion, General Headquarters, Far East Command during the period 5 June 1950 to 26 December 1950 in item 46 (Record of Current Service).

7. Section 6 of the applicant’s WD AGO Form 24A (Service Record) shows he was assigned to Company D, Staff Battalion, Headquarters and Service Group, General Headquarters, Far East Command from 19 April 1949 to 9 October 1950. His Service Record also shows he was assigned to Kunsan, Korea from 12 September 1950 to 4 April 1951.

8. The applicant provided a copy of General Headquarters, Far East Command Special Orders Number 8, dated 8 January 1951. These orders awarded him the Combat Infantryman Badge, effective 23 September 1950, as a member of General Headquarters, 1st Raider Company.
9. The applicant also provided a copy of the history of General Headquarters 1st Raider Company. Facts cited in this history indicate that the 1st Raider Company deployed to Kunsan on 12 September 1950. After its withdrawal from Kunsan, the 1st Raider Company proceeded to Inchon and landed by rubber boat on the Kimpo Peninsula. Due to the strong tidal currents in the Inchon area, the unit landed in the 36th Wave at Inchon then proceeded toward the Kimpo Airbase.

10. Department of the Army Pamphlet 672-1, Unit Citation and Campaign Participation Credit Register, dated 6 July 1961, shows, among other information, campaign credit during World War II and the Korean Conflict. This document shows that the Special Operations Company was awarded the Navy Presidential Unit Citation for actions during the period 15 September 1950 to 11 October 1950 by Department of the Army General Orders Number 63, dated 1952.

11. The applicant’s DD Form 214 shows entitlement to the Korean Service Medal with four bronze service stars.

12. Records show the applicant served in Korea from 12 September 1950 through 4 April 1951. Table B-1 of Army Regulation 600-8-22 (Military Awards) shows the applicant was entitled to credit for participation in four campaigns during his tour in Korea.

13. Army Regulation 600-8-22, in pertinent part, authorizes award of a bronze service star, based on qualifying service, for each campaign listed in Appendix B of this regulation and states that authorized bronze service stars will be worn on the appropriate service medal.

CONCLUSIONS:

1. Based on evidence available to the Board, it appears that the applicant was a participant in the Inchon Landing as a member of the unit referred to in the History of the General Headquarters 1st Raider Company. Therefore, the Board has determined that this evidence is sufficient as a basis for award of the Navy Presidential Unit Citation and correction of his DD Form 214 to show this award.

2. The applicant’s DD Form 214 shows the Korean Service Medal with four bronze service stars.

3. Evidence of record shows he received credit for participation in only four campaigns during his tour in Korea. Therefore, his DD Form 214 is correct as currently constituted and there is no basis for granting the applicant an additional bronze service star for his service in Korea.

4. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records, but only as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the Navy Presidential Unit Citation.

2. That so much of the application as is in excess of the foregoing be denied.
