         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show that he was awarded the Purple Heart (PH).

3. The applicant states that this award was omitted from his DD Form 214, Report of Transfer or Discharge. In support of his application, he submits a copy of his DD Form 214 and a copy of a request for assistance written to his congressman.

4. The applicant’s military records show that he was inducted into the Army of the United States for 2 years on 18 October 1967. Trained as an infantryman, he was sent to Vietnam. He served in Vietnam from 1 April 1968 to 11 January 1969 with Company C, 2nd Battalion, 5th Cavalry, 1st Cavalry Division.

5. On 21 December 1968, the applicant was wounded in the left occipital region of his head. He was hospitalized and evacuated to the United States. He was assigned to Fitzsimons General Hospital as a patient. He was separated with an Honorable Discharge on 30 June 1969 with 1 year, 8 months, and 13 days of creditable service. His DD Form 214 does not show award of the PH.

6. He was awarded the PH by General Orders 560, Headquarters, 1st Cavalry Division, dated 12 January 1969.

CONCLUSIONS:

1. The applicant was wounded in Vietnam and was awarded the PH on 12 January 1969 by General Orders 560, Headquarters, 1st Cavalry Division.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215 (Correction to DD Form 214) awarding him the PH.
