         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the Social Security Number (SSN) shown on his DD Form 214 (Report of Transfer or Discharge) dated 16 July 2001, be corrected to reflect the new SSN issued to him by the United States Social Security Administration (SSA).

3. The applicant states that the SSA erred when they issued him and also another person the same SSN. He further states that he was told by the “Social Security Administration“ that his initial SSN was erroneously issued to him as a child, based on their investigation. He submits a letter from the SSA in Brownsville, Texas, dated 29 June 2001, which shows that the SSA is in the process of moving all of the applicant’s (personal information) wages to his new SSN.

4. The applicant’s military record shows that he enlisted in the Regular Army (RA) from 6 March 1996 through 16 July 1998. On 16 July 2001, the applicant was released from active duty under the provisions of Army Regulation 635-200, chapter 4, for completion of required Active Service with an honorable discharge.

CONCLUSIONS:

1. Evidence provided to the board shows that on 29 June 2001, the SSA, Brownsville, Texas, administratively corrected the applicant’s SSN which was determined to have been erroneously issued to him as a child. He, therefore, is entitled to have item 3 (SSN) on his DD Form 214 corrected to show his new SSN.

2. In view of the foregoing, the applicant's records should be corrected, but only as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by issuing the applicant a DD Form 215 (Correction to DD Form 214) which shows his newly issued SSN.
