         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the award of the Kosovo Campaign Medal (KCM) be added in block #13 of his DD Form 214 (Certificate of Release or Discharge from Active Duty).

3. The applicant states that the KCM was left off of his DD Form 214 due to the transition officer’s refusal to accept his documentation.

4. In support of his application, the applicant submitted Orders Number 179-01, Headquarters, 1st Armored Division, dated 27 June 2000; Military Personnel Message Number 00-180 (Kosovo Campaign Medal); a Memorandum for Record, Headquarters, 501st Forward Support Battalion (FSB), dated 30 August 2000.

5. The applicant’s military records show that he enlisted in the Regular Army on 26 August 1980. Following completion of all military training, the applicant was awarded military occupational specialty (MOS) 92Y, Unit Supply Specialist.

6. On 27 June 2000, the applicant was attached to the 501st FSB and deployed with the 501st in support of Kosovo operations. He served in Kosovo from 21 May 2000 to 2 September 2000.

7. On 31 January 2001, the applicant was honorably retired from active military service by reason of sufficient service for retirement. His DD Form 214 reflects the following awards: Meritorious Service Medal (3rd award), Army Commendation Medal (3rd award), Army Achievement Medal (7th award), Good Conduct Medal (6th award), National Defense Service Medal, NCO Professional Development Ribbon, Army Service Ribbon, and Overseas Service Ribbon (w/Numeral 5).

8. President Clinton approved establishment and award of the Kosovo Campaign Medal (KCM) and campaign streamers to recognize the accomplishments of our military service members who participated in, or were in direct support of, the Kosovo operations within established areas of eligibility (AOE). Individuals authorized the KCM must have participated in, or served in direct support of, one or more of the following Kosovo operations: Allied Force; Joint Guardian; Allied Harbor; Sustain Hope/Shining Hope; Noble Anvil; or Kosovo Task Forces Hawk, Saber, Falcon, or Hunter within the Kosovo Air Campaign or Kosovo Defense Campaign AOE. Service members must have served or be currently serving in a unit participating in or directly supporting the operation for 30 consecutive days in the area of eligibility or for 60 non-consecutive days provided this support involves entering the operations area of eligibility or meets one or more of the following criteria:

(1) Be engaged in actual combat, or duty that is equally as hazardous as combat duty, during the operation with armed opposition, regardless of time in the area of eligibility.
(2) While participating in the operation, regardless of time, is wounded or injured and requires medical evacuation from the area of eligibility.
(3) While participating as a regularly assigned aircrew member flying sorties into, out of, within, or over the area of eligibility in direct support of the military operation.

One bronze star shall be worn on the suspension and service ribbon of the KCM for qualifying participation in each campaign period. A service member who qualified as a participant in one campaign would wear the KCM with one bronze star on the medal and service ribbon.

CONCLUSIONS:

1. The evidence of record confirms the applicant met the requirements for award of the Kosovo Campaign Medal with one bronze service star.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215, Correction to DD Form 214) showing that he was awarded the Kosovo Campaign Medal with one bronze service star.
