THE BOARD ADDITIONALLY FINDS:
10. The Board’s previous recommendation in this case (AR2000050643) on
1 March 2001 was for promotion to captain with an adjusted date of rank of
10 October 1998, with entitlement to pay and allowances in the higher grade on that date. The recommendation was approved on 9 March 2001.
11. On 2 May 2001, an official of the Defense Finance and Accounting Services contacted a staff member of the Board and advised her that pay records show the applicant presently has a date of rank for captain of 10 September 1998.
12. On the same date, the staff member contacted an official of the Office of Promotion, Reserve Promotions and advised her to hold the 1 March 2001 Board proceedings on the applicant until further notice. The staff member further requested verification of the applicant’s date of rank for captain.
13. On 26 July 2001, the Reserve Promotions official advised the staff member of the Board that the applicant was promoted to captain with a date of rank 10 September 1998.
14. On 2 August 2001, the staff member was also advised by the Reserve Promotions official that the applicant’s date of rank for captain was 10 September 1998.
15. The Acting Principal Deputy Assistant Secretary of the Army (Manpower and Reserve Affairs) acknowledged that pertinent Army agencies had agreed that the faulty promotion policy for promotion to captain under the Reserve Officer Personnel Management (ROPMA) should be revised. He further stated that affected individuals would be advised they could seek relief from the Army Board for Correction of Military Records which could adjust the date of rank for those who were first-time considered and selected for promotion to captain, after having served more than 7 combined maximum years of service in grade as a lieutenant.
16. Promotion boards for captains were administratively delayed during 1996 through 1999. The Presidential approvals of the results of the pertinent promotion boards were also administratively delayed. Based on the normal processing, they should have been convened earlier and approved approximately 100 days after the respective board recess dates.
THE BOARD ADDITIONALLY CONCLUDES:
6. At the time of the Board’s 1 March 2001 decision in this case, it was the intent of the Board to make the applicant’s record as administratively correct as it should properly have been at the time of his promotion to captain. However,
adjusting the applicant’s date of rank to a later date than that of current record is detrimental to him, causing him a loss of pay and delayed future promotion consideration. The policy of the board is not to render a record any worse off than it was before the Board’s determination.
7. The Board’s previous action in this case clearly was detrimental to the applicant and will cause a negative impact on his career, not intended by the Board.
8. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records as recommended below to show there is no longer a basis for adjusting the applicant’s date of rank for captain, by showing his date of rank for captain remains as 10 September 1998, and that the Board’s previous determination was denial of his request.
THE BOARD RECOMMENDS:
That all of the Department of the Army records related to this case be corrected by deleting the applicant’s name from the 1 March 2001 ABCMR List Case (ROPMA Project) – Phase 2 (Blue), by showing his request for an adjusted date of rank is denied and by showing his date of rank for captain remains as 10 September 1998.

He was promoted to first lieutenant effective 24 July 1988 and to captain effective 1 June 1991. The Chief, Promotion and Notifications Branch, Office of Promotions, PERSCOM, expressed the opinion that the applicant was promoted to captain 1 June 1991 and promotion to major requires 7 years time in grade; therefore, his promotion eligibility date for major was 31 May 1998. The Reserve Officer Personnel Act in effect prior to ROPMA required completion of 3 years as a 2LT and 4 years as a 1LT before promotion to CPT. With respect to the applicant's DOR to CPT, the evidence of record shows that based on the maximum of 7 years of service as a 2LT and 1LT, the applicant's MYIG date for promotion to CPT was 30 May 1997. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. showing his effective...

ROPMA provides that in order to be eligible for promotion to major the MTIG for a captain is 7 years, and that an officer selected for the first time for promotion to the next higher grade may be promoted on or before the date that he/she completed the maximum service. Promotion to major requires 7 years time in grade; therefore, his promotion eligibility date was 20 May 1998. Notwithstanding the delay, the effective date of his promotion should remain as 31 August 1998, the date the...

On 19 November 2002, the Board advised the applicant that the records indicated he was a member of a TPU and his DOR and effective date for promotion to captain had been correctly established as 9 January 1999, the date he was assigned to a captains position. The Reserve Officer Personnel Act in effect prior to ROPMA required completion of 3 years as a second lieutenant and 4 years as a first lieutenant before promotion to captain. The evidence shows the applicant was appointed as a...

The applicant requests, in effect, adjustment to his date of rank for captain from 18 August 1999 to 25 June 1998, based on a change to the Army Reserve time in grade promotion policy. The board results were approved on 18 August 1999 and the applicant was promoted to captain effective that date. It is also noted that the applicant should not expect his date of rank to be changed to the approval date of the 1998 AMEDD RCSB as he had not been considered and selected for a Reserve promotion...
