         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that her DD Form 256A (Certificate of Honorable Discharge - US Army) and her "official letter" [her discharge order] be corrected to show her rank as sergeant (SGT).

3. The applicant states that she was a SGT, but her DD Form 256A and her discharge order show her rank as specialist (SPC).

4. The applicant's records show that she was promoted to SGT on Orders 95-004-088, Headquarters, 124th US Army Reserve Command, Fort Lawton, Washington, effective 5 January 1995.

5. On 3 November 1998, the applicant was separated from the US Army Reserve as a SPC on Orders D-11-871403, Headquarters, US Army Reserve Personnel Command (AR-PERSCOM), St. Louis, Missouri.

6. On 27 August 2001, the AR-PERSCOM corrected the applicant's DD Form 256A to show her rank as SGT.

CONCLUSIONS:

1. The applicant was a SGT at the time of her discharge on 3 November 1998. The AR-PERSCOM has already corrected her DD Form 256A.

2. In view of the foregoing, the applicant’s records should be corrected, but only as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by amending the discharge orders of the individual concerned to show that she was separated as a SGT, not a SPC.


2. That so much of the application as is in excess of the foregoing be denied.
