         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that he be awarded the Bronze Star Medal.

3. The applicant states that he heard that all infantrymen were entitled to the award.

4. The applicant’s military records were lost or destroyed in the 1973 fire at the National Personnel Records Center. His WD AGO Form 53-55 (Report of Separation) shows that he was inducted and entered active duty on 13 September 1944. He served in the European Theater as a rifleman from 8 February 1945 to 28 May 1946. His authorized awards include the Purple Heart and the Combat Infantryman Badge.

5. Army Regulation 600-8-22 provides, in pertinent part, that the Bronze Star Medal is to be awarded to individuals who had been cited in orders for exemplary conduct in ground combat or whose meritorious achievement had been otherwise documented prior to 1 July 1947. Authorization of the Combat Infantryman Badge for service during World War II is considered qualifying documentation under this provision.

CONCLUSIONS:

1. The applicant served in combat as a rifleman in World War II and was awarded the Combat Infantryman Badge. He is entitled to an award of the Bronze Star Medal.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case for the individual concerned be corrected by awarding him the Bronze Star Medal based on the award of the Combat Infantryman Badge.
