         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Certificate of Release or Discharge from Active Duty, DD Form 214, be amended to add the Armed Forces Expeditionary Medal (AFEM).

3. The applicant makes no additional statement. He provides a copy of the AFEM award certificate as supporting evidence.

4. The applicant’s military records show that he enlisted in the Regular Army on 21 August 1997. His military personnel records do not show that he served in Southwest Asia; however, records at the Defense Finance and Accounting Service (DFAS) show he drew hostile fire pay from 1 December 1998 – 31 March 1999. The award certificate he provides shows he served in Southwest Asia from 1 November 1998 to 15 March 1999.

5. The applicant was awarded the Army Commendation Medal (ARCOM) on Permanent Orders 158-11, Headquarters 108th Air Defense Artillery Brigade, Fort Bliss, TX dated 6 June 2000.

6. The applicant was released from active duty on 20 August 2000. His DD Form 214 does not list the AFEM or the ARCOM.

7. U. S. Total Army Personnel Command message 121828Z June 1996, Subject: AFEM for U. S. Army Forces Central Command-Qatar in Support of Operation Southern Watch; Military Personnel Message 98-161, 291530Z July 98, Subject: Award of the AFEM for Operations in Southwest Asia; and Military Personnel Message 99-101, 121618Z March 1999, Subject: Expansion of the Area of Eligibility for Award of the AFEM for Operations in Southwest Asia all authorized award of the AFEM for service in Southwest Asia.

CONCLUSIONS:

1. The Board concludes that the AFEM award certificate, corroborated by evidence from DFAS, is sufficient to show the applicant is entitled to award of the AFEM. His DD Form 214 should be amended to add the AFEM and the ARCOM.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by amending the applicant’s DD Form 214 to show he was awarded the AFEM and the ARCOM.
