         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 4/3 (continuation of the DD Form 4/1 (Enlistment/Reenlistment Document)) to show that he enlisted in the Regular Army for a period of 4 years instead of 8 years.

3. The applicant states that the incorrect term of enlistment is shown on this DD Form 4 Series. In support of his application, he submits a copy of his Reservation print out; DD Form 4 Series; and DA Form 3286 (Statement for Enlistment/United States Army Enlistment Program/U.S. Army Delayed Enlistment Program) Series.

4. The applicant’s military records show that he enlisted in the U.S. Army Reserve (USAR) on 19 June 2000 under the delayed entry program. He entered active duty on 21 June 2001.

5. Item F (Discharge form Delayed Entry/Enlistment Program) on the applicant’s DD Form 4/3 shows that he enlisted in the Regular Army for a period of 8 years.

6. The applicant’s DD Form 4/1 (Enlistment/Reenlistment Document), dated
19 June 2000, shows that he enlisted in the USAR under the delayed entry program with the understanding that his enlistment in the Regular Army would be for not less than 4 years.

7. The applicant’s entire DD Form 3286 series show that his term of enlistment in the Regular Army is 4 years.

8. DD Form 1966/1 (Record of Military Processing – Armed Forces of the United States) shows the applicant’s term of enlistment is for 4 years.

9. The applicant provided a copy of his Reservation print out, dated 19 June 2000, which shows that his term of enlistment is for 4 years.

CONCLUSIONS:

1. The evidence of record clearly shows that the applicant enlisted in the Regular Army for a period of 4 years. Therefore, his DD Form 4/3 which indicates that he enlisted for a period of 8 years was the result of an administrative error. Accordingly, the applicant’s DD Form 4/3 should be corrected to show that he enlisted in the Regular Army for a period of 4 years.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.




RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned enlisted in the Regular Army for a period of 4 years on his DD Form 4/3.
