         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show his correct date of birth and his correct grade at separation. In support of his request the applicant submits copies of his separation reports and his birth certificate.

3. The applicant states that his correct date of birth is 1 November 1919 and not
1 November 1918, and that he was upgraded to Technical Sergeant prior to his separation.

4. The applicant’s military records were lost or destroyed in the National Personnel Records Center fire of 1973. Information herein was obtained from documents provided by the applicant.

5. The applicant's WD AGO Form 53-55 (Enlisted Record and Report of Separation) effective 4 May 1946, and his DD Form 214 (Report of Separation from the Armed Forces of the United States) effective 29 November 1950, shows his date of birth as 1 November 1918, and that he was separated from his last period of service in the grade of Sergeant.

6. A certified copy of the applicant's birth certificate shows he was born on
1 November 1919.

CONCLUSIONS:

1. The applicant’s birth certificate verifies he was born on 1 November 1919 and not 1 November 1918, and as such his records should be corrected to show his correct date of birth of 1 November 1919.

2. There are no available records nor did the applicant provide documentation to substantiate his claim that he was promoted to Technical Sergeant prior to his discharge.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by changing the applicant's date of birth to read 1 November 1919, instead of 1 November 1918.






2. That so much of the application as is in excess of the foregoing be denied.
