         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his DD Form 214 be corrected to show the awards to which he is entitled.

3. The applicant states that there was a problem with his name in his active duty unit, implying that he therefore did not get the medals that he was awarded.

4. The applicant’s military records are those submitted by the applicant.

5. Headquarters I Corps and Fort Lewis permanent orders 194-1, dated 13 July 1999 show that A Company, 864th Engineer Battalion (-) was directed to a temporary change of station to Skopje, Macedonia, effective 21 July 1999.

6. On 2 January 2000 the applicant was awarded the Army Achievement Medal for meritorious achievement while deployed to Kosovo. The award recommendation shows that the applicant’s unit was A Company, 864th Engineer Battalion, located at Camp Bondsteel, Kosovo.

7. MILPER message dated 22 May 2000 indicated that the President approved award of the Kosovo Campaign Medal for service members who participated in or served in direct support of Kosovo operations for 30 consecutive or 60 nonconsecutive days in the area of eligibility from 11 June 1999 to a date to be determined. The area of eligibility included Macedonia.

8. Total Army Personnel Command (PERSCOM) message dated 27 June 2000 indicated that the Secretary of Defense had approved the acceptance and wear of the NATO Medal for operations related to Kosovo. Criteria included participation in NATO operations related to Kosovo for 30 days from 13 November 1998 to a date to be determined. The area of eligibility included Macedonia.

9. A 3 August 2000 unsigned PERSCOM memorandum provides information concerning the Kosovo Campaign Medal.

10. The applicant’s DD Form 214 shows that he entered on active duty on 28 January 1998 and was released from active duty at Fort Lewis, Washington, on 27 January 2001. He had 3 years of service. His last duty assignment was with the 864th Engineer Battalion. His DD Form 214 shows that he was awarded the Army Service Ribbon and the Marksman Qualification Badge with rifle bar. It does not reflect any other awards.

11. Information obtained from the Defense Finance and Accounting Service (DFAS) on 3 October 2001 revealed that the applicant received hostile fire pay from 1 August 1999 to 29 February 2000, and foreign duty pay from 30 August 1999 to 23 February 2000.

CONCLUSIONS:

1. The applicant was awarded the Army Achievement Medal. That award should be reflected on his DD Form 214.

2. The applicant is entitled to award of the NATO Medal and the Kosovo Campaign Medal. Those awards should be reflected on his DD Form 214.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Army Achievement Medal, the NATO Medal, and the Kosovo Campaign Medal.
