         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests award of the Army of Occupation Medal (AOM) – Japan. He makes no additional statement.

3. The applicant’s military records show that he entered active service on 16 April 1945. His Service Record, WD AGO Form 24, shows that he arrived at Wakayama, Honshu, Japan on 14 November 1945. On 28 November 1945, he arrived at Nagano, Honshu, Japan. He was transferred to the 4th Replacement Depot on orders issued by Headquarters, Kobe (Japan) Base with a departure date of 17 April 1946.

4. Army Regulation 600-8-22 prescribes Army policy and criteria concerning individual military awards. The AOM – Japan is awarded for service for 30 consecutive days at a normal post of duty between 3 September 1945 and 27 April 1952 in the four main islands of Japan and the surrounding smaller islands of the Japanese homeland.

CONCLUSIONS:

1. The Board concludes that the available evidence of record shows that the applicant met the eligibility criteria for award of the AOM – Japan. He arrived in Japan in November 1945. The Board presumes that his reassignment orders to the 4th Replacement Depot issued by Headquarters, Kobe (Japan) Base were issued by that headquarters because he was still assigned to Japan. He departed Japan on 14 April 1946. Therefore, he met the 30 consecutive days of service requirement.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s WD AGO Form 53-55 be amended to add the Army of Occupation Medal – Japan.
