         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that all of his awards and his training be reflected on his DD Form 214.

3. The applicant states that he was awarded the Air Medal, the Army Commendation Medal with “V” device, and two Bronze Star Medals. He completed the Combat Engineer NCO School Skill Development Base Course.

4. The applicant’s military records show that he entered on active duty on 7 August 1969, completed training as a combat engineer, and sometime in the spring of 1970 completed the NCO school skill development base course. In July 1970 the applicant was assigned as an assistant squad leader with an engineer battalion in Vietnam. The applicant returned to the United States in February 1972 and was released from active duty on 5 February 1972 with the rank of Sergeant at Fort Lewis, Washington. He had 2 years, 5 months, and 29 days of service, of which 1 year, 6 months, and 29 days were in Vietnam. He participated in three campaigns during his tour in Vietnam.

5. The applicant’s DD Form 214 only shows award of the National Defense Service Medal, the Sharpshooter and Expert Qualification Badges (with the M-14 and the M-16 rifles, respectively), the Vietnam Service Medal, the Bronze Star Medal, the Army Commendation Medal with first oak leaf cluster, and the Republic of Vietnam Campaign Medal. It does not show completion of the NCO school skill development base course.

6. The applicant’s documents that he furnished with his application show that he was awarded the Air Medal, two awards of the Bronze Star Medal for meritorious service, and the Army Commendation Medal with “V” device (first oak leave cluster). Additionally, his record shows that he was awarded a Bronze Star Medal for meritorious achievement for the period 28 September 1970 to 16 October 1970.

7. Department of the Army General Orders 8,1974, announced award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation for service in Vietnam to United States Army Vietnam and its subordinate units during the period 20 July 1965 to 28 March 1973.

8. Army Regulation 600-8-22 provides that the Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency and fidelity
during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the
termination of a period of Federal military service. Although there is no automatic entitlement to the Good Conduct Medal, disqualification must be justified.


CONCLUSIONS:

1. The applicant was awarded the Air Medal, the Army Commendation Medal with “V” device, and three awards of the Bronze Star Medal. Those awards should be reflected on his DD Form 214.

2. The applicant participated in three campaigns during his service in Vietnam. His record should show award of the Vietnam Service Medal with three bronze service stars (one for each campaign). The award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation should be shown on his DD Form 214.

3. The applicant served his country honorably and faithfully. He is entitled to award of the Army Good Conduct Medal.

4. The applicant completed the Combat Engineer NCO School Skill Development Base Course. That information should be entered on his DD Form 214.

5. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Air Medal, the Army Commendation Medal with “V” device (first oak leaf cluster), three awards of the Bronze Star Medal, the Vietnam Service Medal with three bronze service stars, the Republic of Vietnam Gallantry Cross with Palm Unit Citation, and the Army Good Conduct Medal. Additionally, his DD Form 214 should reflect that he completed the Combat Engineer NCO School Skill Development Base Course.
