DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. The applicant’s medical record shows that he was in an automobile accident, treated and released back to a duty status. The incident was never shown to be combat related, attributed to hostile action from the enemy or that he incurred a wound as a result. The applicant’s remaining medical records apply to his reserve duty. He never reported that the facial scar was the result of a combat related wound.
2. There is no evidence of record, and the applicant has provided no evidence, which shows that he was awarded the Purple Heart, that he was wounded in action on 1 April 1969, or that he underwent medical treatment for wounds received as a result of hostile action at any other time.
3. The overall merits of the case, including the latest submissions and arguments, are insufficient as a basis for the Board to reverse its previous decision.
4. In view of the foregoing, there is no basis for granting the applicant's request other than to remove 8 pages of medical forms belonging to another individual, which were on file in his record in error.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

It states: a. in order to support award of the Purple Heart there must be evidence that the wound for which the award is being made was received as a result of enemy action; that it required treatment by military medical personnel; and a record of this treatment must have been made a matter of official record. The record also shows that based on his RVN service and campaign participation, he is entitled to: * 2 bronze service stars for wear on his already-awarded Vietnam Service Medal * RVN...

He states that he was among the wounded. The available evidence also shows the applicant was awarded the Purple Heart for wounds received as a result of being hit by nails from a claymore on 11 April 1969. Evidence of record shows that although he received orders for a Purple Heart for wounds received on 4 August 1969 while assigned to the 12th Evacuation Hospital there is no evidence of record nor did the applicant provide any evidence which shows he was wounded on 4 August 1969.

The applicant requests correction of his records to show he served in the Republic of Vietnam (RVN) and that he was awarded the Purple Heart. Records show the applicant served in the RVN from 8 February to 19 June 1969; however, item 30 of his DD Form 214 fails to document his service in Vietnam. There is no evidence in the applicants military personnel records that shows he was wounded as a result of hostile action; his DA Form 20 does not list the Purple Heart in item 41; the...

When he was allegedly wounded in a mortar attack around November or December 1967 and received shrapnel in the right shoulder and right arm, his statement to his MOC does not indicate he received medical treatment until allegedly several days later when he was required to be evacuated because he had developed infection and swelling of the lymph nodes. Evidence shows that the applicant’s records contain administrative error which does not require action by the Board. Therefore, the Board...

The applicant states, in effect, he sustained shrapnel wounds during a mortar and rocket attack on the evening of 26 March 1969 while stationed at Dong Tam base camp in the Republic of Vietnam (RVN).
