2. The applicant requests, in effect, that he be awarded the Purple Heart.
3. The applicant states, in effect, that he was wounded during World War II but his discharge document does not list a Purple Heart.
4. The applicant’s military records show that he was inducted on 21 October 1942. He rose to the rank of Technical Sergeant. He was assigned to
Company B, 56th Armored Infantry Battalion, 12th Armored Division, while it was engaged in combat in France. He was awarded the Combat Infantryman Badge (CIB) on 11 December 1944 while assigned to this unit.
5. His enlisted record shows that he received a penetrating wound in the shoulder blades on 16 January 1945 in France. The wound for which the award is made must have required treatment by medical personnel and records of medical treatment for wounds or injuries received in action must have been made a matter of official record.
CONCLUSIONS:
1. The applicant was wounded in battle and entitled to award of the Purple Heart.
2. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION:
That all of the Department of the Army records related to this case be corrected for the individual concerned by showing that he was awarded the Purple Heart and providing him with the medal.

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. The applicant states that he just found out it was possible to correct his records. The available military medical records state that his right ear deafness was caused secondary to a concussion from enemy mortar fire in France.

Army Regulation 600-8-22, Military Awards, provides, in pertinent part, that the Purple Heart is awarded for a wound sustained as a result of hostile action. Hospital admission information for the year 1944, maintained by the OTSG, shows that the applicant was wounded in action in France in 1944, which entitles him to award of the Purple Heart. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Purple...

In the absence of evidence to explain either wounding, the Board will assume for purposes of correcting his records, that he was wounded on both 17 July and 8 August 1944, and award him a Purple Heart for each wound. Consequently, there is no basis for the Board to consider awarding him the POW Medal. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Purple Heart with 1 st Oak Leaf Cluster, for wounds...

The Board notes that the applicant’s WD AGO Form 53-55 shows that he was wounded in action twice; however, the available medical evidence shows that the injury incurred in August 1944 was a non-battle injury (i.e., non-hostile action). In view of the foregoing, the applicant’s records should be corrected as recommended below. That all of the Department of the Army records related to this case be corrected by awarding the Purple Heart to the applicant for wounds received on 3 January 1945...

Frostbite or trench foot injuries were also examples of injuries or wounds which clearly do not justify award of the Purple Heart DISCUSSION AND CONCLUSIONS: 1. The applicant's WD AGO Form 53-55 shows no combat wounds were recorded on his separation document. As he was not treated for a combat injury, there is no basis for awarding him the Purple Heart.
ARMY | BCMR | CY2005 | 20050000544C070206
