PROCEEDINGS

         IN THE CASE OF:

         BOARD DATE: 16 October 2001
         DOCKET NUMBER: AR2001057714

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Ms. Deyon D. Battle Analyst

The following members, a quorum, were present:

Mr. Raymond V. O’Connor, Jr. Chairperson
Mr. Donald P. Hupman, Jr. Member
Ms. Regan K. Smith Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that his Enlisted Record and Report of Separation (WD AGO Form 53-55) be corrected to show his service organization as Battery A, 949th Field Artillery Battalion.

3. The applicant states that Battery D, 182nd Field Artillery Battalion was redesignated as Battery A, 949th Field Artillery Battalion and ordered to active duty. In support of his appeal he submits a copy of his Army financial records.

4. The applicant's military records were lost or destroyed in the National Personnel Records Center fire of 1973. Information herein was obtained from alternate sources.

5. He enlisted in the Army National Guard of the United States on 7 July 1939 and he successfully completed his training as a K gun crewman. He was assigned to Battery D, 182nd Field Artillery Battalion prior to being ordered to active duty on 7 April 1941.

6. A review of the applicant’s financial record shows that Battery D, 182nd Field Artillery was redesignated as Battery A, 949th Field Artillery Battalion on 31 March 1943.

7. He was honorably discharged on 29 October 1945. The WD AGO Form
53-55 that he was furnished at the time of his discharge shows his service organization as the Battery D, 182nd Field Artillery.

CONCLUSIONS:

1. It appears that an error was made during the preparation of the WD AGO Form 53-55 which resulted in the incorrect unit of assignment being reflected.

2. The available evidence clearly shows that the Battery D, 182nd Field Artillery Battalion was redesignated as Battery A, 949th Field Artillery Battalion on 31 March 1943. Therefore, it is reasonable to presume that his WD AGO Form 53-55 is incorrect as currently reflected and it should be corrected to reflect the appropriate organization.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was assigned to Battery A, 949th Field Artillery Battalion prior to his discharge on 29 October 1945.
