MEMORANDUM OF CONSIDERATION

         IN THE CASE OF:

         BOARD DATE: 12 July 2001
         DOCKET NUMBER: AR2001056464

I certify that hereinafter is recorded the record of consideration of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Mrs. Nancy Amos Analyst

The following members, a quorum, were present:

Ms. Margaret K. Patterson Chairperson
Mr. Melvin H. Meyer Member
Mr. Terry L. Placek Member

The Board, established pursuant to authority contained in 10 U.S.C. 1552, convened at the call of the Chairperson on the above date. In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice.

The applicant requests correction of military records as stated in the application to the Board and as restated herein.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

APPLICANT REQUESTS: That his uncharacterized description of service be changed to honorable.

APPLICANT STATES: The applicant makes no additional statement.

EVIDENCE OF RECORD: The applicant's military records show:

He enlisted in the U. S. Army Reserve on 27 February 1990. He attended initial active duty training (IADT) from 21 March 1990 through 25 July 1990. He was released from IADT on 25 July 1990 after completing 4 months and 5 days of creditable active service.

Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Paragraph 3-9 states that a separation will be described as an entry level separation with service uncharacterized if processing is initiated while a soldier is in an entry level status unless the reason for separation requires a specific characterization. For Reserve component soldiers, entry level status begins upon enlistment in the Reserve component and terminates (1) for soldiers ordered to IADT for one continuous period -- 180 days after beginning training or (2) for soldiers ordered to IADT for the split or alternate training option -- 90 days after beginning Phase II (advanced individual training).

DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.

2. The applicant was released from IADT prior to completion of 180 days of active duty; therefore, the description of his service as uncharacterized was appropriate.

3. In view of the foregoing, there is no basis for granting the applicant's request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

BOARD VOTE:

The evidence of record confirms the applicant completed BCT on 21 July 1989, and did not enter active duty to complete AIT until 2 July 1990. Given the applicant was separated prior to completing 90 days of active duty service during her AIT phase of training, her service was properly described as uncharacterized in accordance with the applicable regulation. Therefore, the time for her file a request for correction of any error or injustice expired on 5 September 1993.

Only the honorable characterization may be awarded to a Soldier upon completion of his/her period of enlistment or period for which called or ordered to active duty or active duty for training, or where required under specific reason for separation, unless an entry-level status separation (uncharacterized) is warranted (emphasis added): and (2) a general discharge is a separation from the Army under honorable conditions. The DD Form 214 he was issued shows that he had 4 months and 12 days of active service and his character of service was "Uncharacterized." While the applicant undoubtedly served his IADT honorably, Army regulations mandate that if a Soldier is an entry-level status then his or her service will be uncharacterized. _______ _ X _______ ___ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case.
