         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) with a separation date of 31 March 2001.

3. The applicant states that item 11 (Primary Specialty) of his DD Form 214
with a separation date of 31 March 2001 should be corrected to show the entry
“92Y30 12 YRS, 75H (75B) 15 YRS, 51K (51N) 14 YRS 2 MOS, 77W (51N)
14 YRS, 2 MOS, 16S (14M) 3 YRS, 10 MOS”, item 13 (Awards and Decorations) to show the Army Reserve Components Overseas Training Ribbon, the Army Commendation Medal (First Oak Leaf Cluster), and item 14 (Military Education) to show that he completed the Hazardous Waste Operations and Emergency Response Course in 1994, the Unit Clerk Course, and the Unit Armorers Course. In support of his application he submits two DD Forms 214 (dated 27 January 1985 and 31 March 2001), a copy of his DD Form 215, Correction to DD Form 214 issued on 27 January 1985, a copy of his DA Form 2-1 (Personnel Qualification Record), four military occupational specialty (MOS) orders, a copy of a support certificate, dated 2 November 2000, two award certificates, two DA Forms 638 (Recommendation for Award), two course completion certificates, a copy of his DA Form 1059 (Service School Academic Report), and a copy of a memorandum showing he completed the Unit Armorer Course, dated 14 January 1993.

4. The applicant’s military records show that he enlisted on 28 January 1981
as a water treatment specialist (51N10). He continued to serve until he was honorably released from active duty on 27 January 1985. He was transferred
to the USAR Control Group (Reinforcement). He continued to serve until he was released from the USAR and assigned to the New York Army National Guard (NYARNG) on 22 February 1985.

5. He reenlisted in the NYARNG on 6 May 1985. He continued to serve through
a series of continuous reenlistments until he was placed on the Army of the United States Retired List from the NYARNG in the pay grade of SSG/E6 on 31 March 2001.

6. Item 11 (Primary Specialty) of his DD Form 214 with a separation date
of 31 March 2000, shows the entry “92Y30 00 Unit Supply Specialist
- -7 YRS – 8 MOS// 75H30 00 Personnel Actions NCO-15 YRS -
11 MOS//51K30 00 Plumber-14 YRS - 0 MOS//77W30 00 Water Treatment
SP – 14 YRS – 0 MOS//16S30 00 MANPADS Crewmember - 3 YRS -
9 MOS//Nothing Follows.”

7. Headquarters, 1st Battalion, 210th Armor, New York Army National Guard Orders 20-1, dated 10 March 1986, shows that the applicant was awarded the primary military occupational specialty (PMOS) of “75B20”, secondary military occupational specialty (SMOS) of “51N20”, and had withdrawn the PMOS of “51N20” effective 10 March 1986.

8. Headquarters, 1st Battalion, 210th Armor, New York Army National Guard Orders 5-2, dated 28 January 1987, shows that the applicant was awarded the PMOS of “75B20”, the SMOS of “77W20”, the AMOS of “51K20”, and had withdrawn the SMOS of “51N20.”

9. Headquarters, US Army Logistics Center and Fort Lee (PROV) Orders
28-42, dated 24 February 1989, show that the applicant was awarded the PMOS of “76Y20”, the SMOS of “75B20”, the AMOS of “77W20”, and had withdrawn the PMOS of “75B20” and SMOS of “77W20” effective 24 February 1989.

10. The applicant was promoted to the pay grade of SSG/E6 on 9 March 1994.

11. 56th Personnel Service Battalion, New York Army National Guard Orders
7-1, dated 12 May 1997, shows the applicant was awarded the PMOS of “97Y30”, the SMOS of “75H30”, the AMOS of “77W30”, AMOS of “51N30”,
and the AMOS of “14M30” effective 12 May 1997.

12. The applicant provided a copy of support certificate from the 56th Personnel Services Battalion, NYARNG, dated 2 November 2000, which authorized the applicant to wear the Army Reserve Components Overseas Training Ribbon.

13. The applicant provided two DA Forms 638, which shows that he was awarded the Army Commendation Medal by Headquarters, 42nd Infantry Division, NYARNG Permanent Orders 32-1, dated 21 November 1991, and
the Army Commendation Medal (First Oak Leaf Cluster) by Division of Military and Naval Affairs Permanent Orders 172-008, dated 21 June 1999.

14. The applicant completed the Hazardous Waste Operations and Emergency Response Course in July 1994, the Unit Clerk Course in August 1985, and the Unit Armorers Course in January 1993, as evidenced by certificates of completion he provided with his application. The 14 January 1993 memorandum that noted his completion of the Unit Armorers Course states that it was a 2-day course, 8-9 January 1993.

15. Army Regulation 635-5 establishes the policies and procedures for completion and distribution of the DD Form 214. In pertinent part, it states
that the PMOS, AMOS, and areas of concentration (AOC) served in for a period of one year or more, during the soldier’s continuous active duty will be entered in item 11 (Primary Specialty). Item 14 (Military Education) will list formal, in service training courses of 40 hours or more successfully completed during the period of service covered by title, length in weeks, and month and year completed.


16. Army Regulation 600-8-22, in pertinent part, provides for award of the Army Reserve Components Overseas Training Ribbon (ARCOTR). It is awarded to members of the Reserve Components of the Army, (Army National Guard and U.S. Army Reserve), for successful completion of annual training (AT) or active duty for training (ADT) for a period not less than 10 consecutive duty days on foreign soil.

CONCLUSIONS:

1. The evidence of record shows that the applicant was awarded the PMOS of “76Y20” on 24 February 1989, and was awarded the PMOS of “92Y30” (formerly known as 76Y Unit Supply Specialist) on 12 May 1997. The evidence also shows that the applicant has a cumulative total of 12 years, and 1 month of total service as a “92Y30”. Therefore, he is entitled to correction of his DD Form 214 with a separation date of 31 March 2001 to show the entry “92Y30 00 Unit Supply Specialist 12 YRS - 1 MOS.”

2. The evidence of record shows that the applicant was awarded the PMOS of 75B20 on 10 March 1986, was awarded the SMOS of 75B20 and had withdrawn the PMOS of 75B20 on 24 February 1989, and was awarded the SMOS of 75B30 (formerly known as 75B Personnel Administrative Specialist) on 12 May 1997. The evidence also shows that the applicant has a cumulative total of
15 years, and 1 month of total service as a “75H30”. Therefore, he is entitled to correction of his DD Form 214 with a separation date of 31 March 2001 to show the entry “75H30 00 Personnel Services NCO 15 YRS - 1 MOS.”

3. The evidence of record shows that the applicant was awarded the AMOS of “51K20” on 28 January 1987, and was awarded the AMOS of “51N30”
(formerly known as 51K Plumber) on 12 May 1987. The evidence of record also shows that the applicant has a cumulative total of 14 years and 2 months of total service as a “51N30”. Therefore, he is entitled to correction of his DD Form 214 with a separation date of 31 March 2001 to show the entry ”51K30 00 PLUMBER 14 YRS - 2 MOS.”

4. The evidence of record shows that the applicant was awarded the SMOS of
“77W20” (formerly known as 51N Water Treatment Specialist) on 28 January 1987, the AMOS of “77W20” on 24 February 1989, had withdrawn the SMOS of “77W20” on 24 February 1989, and was awarded the AMOS of “77W30” by Orders Number 7-1, dated 12 May 1997. The evidence of record also shows that the applicant has a cumulative total of 14 years and 2 months of total service as a “77W30”. Therefore, he is entitled to correction of his DD Form 214 with a separation date of 31 March 2001 to show the entry “77W30 00 WATER TREATMENT SP 14 YRS - 2 MOS.”

5. The evidence of record shows that the applicant was awarded the AMOS of “14M30” (currently known as “16S Man Portable Air Defense System Crewmember”) on 12 May 1997. The evidence of record also shows that the applicant has a cumulative total of 3 years and 2 months of total service as a “16S30”. Therefore, he is entitled to correction of his DD Form 214 with a separation date of 31 March 2001 to show the entry “16S30 00 MANSPAD Crewmember 3 YRS - 10 MOS.”

6. The evidence of record shows that the applicant was entitled to wear the Army Reserve Components Overseas Training Ribbon. Therefore, he is entitled to correction of his DD Form 214 with a separation date of 31 March 2001 to show this award.

7. The evidence of record shows that the applicant was awarded the first and second awards of the Army Commendation Medal. Therefore, he is entitled to correction of his DD Form 214 with a separation date of 31 March 2001 to show the Army Commendation Medal (First Oak Leaf Cluster).

8. The evidence of record shows the applicant completed the Hazardous Waste Operations and Emergency Response Course in July 1994 and the Unit Clerk Course in August 1989. Therefore, he is entitled to correction of item 14 (Military Education) of his DD Form 214 to show the entry “Hazardous Waste Operations and Emergency Response Course, 1 week, July 1994” and to show the entry “Unit Clerk Course, 3 weeks, August 1989.”

9. The Board notes that the Unit Armorers Course was 2-days in length. Therefore, he is not entitled to correction of item 14 (Military Education) of his DD Form 214 to show the Unit Armorers Course.

10. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s records, but only as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case for the individual concerned be corrected on his DD Form 214 with a separation dated of 31 March 2001:

a. by showing in item 11 (Primary Specialty) the entry “92Y30 00 Unit Supply Specialist 12 YRS - 1 MOS//75H30 00 Personnel Services NCO
15 YRS - 1 MOS//51K30 00 PLUMBER 14 YRS - 2 MOS//77W30 00 WATER TREATMENT SP 14 YRS - 2 MOS//16S30 00 MANSPAD Crewmember
3 YRS - 10 MOS//NOTHING FOLLOWS”;

b. by showing in item 13 (Awards and Decorations) that he was awarded the Army Reserve Components Overseas Training Ribbon, and the Army Commendation Medal (First Oak Leaf Cluster); and

c. by showing in item 14 (Military Education) the entry “ Hazardous Waste Operations and Response Course, 1 week, July 1994”, and the “Unit Clerk Course, 3 weeks, August 1989.”

2. That so much of the application as is in excess of the foregoing be denied.
