2. The applicant requests, in effect, that he be granted 20 years qualifying service for retirement at age 60.
3. The applicant states, in effect, that he thought he had 20 years qualifying service for retirement at age 60 after having requested a letter of eligibility for retirement and receiving a 5AA Form 333 (AG), (Eligibility for Retired Pay Worksheet), dated 27 June 1981, which verified that he had 20 good years of service in the military which established his eligibility for retired pay at age 60. When he applied for retired pay on 3 March 1999, it came to his attention that not only is the time added incorrectly, but the wrong social security number is listed. He provides a copy of the 5AA Form 333, a copy of a Chronological Statement of Retirement Points, dated 5 February 1984, showing that he has 19 years,
4 months, and 23 days qualifying for retirement at age 60, and three DD Forms 214 (Report of Transfer or Discharge) for three periods of active duty from 30 June 1960 through 22 November 1968.
4. The applicant’s military records show that he served as an enlisted soldier on active duty for three periods as shown below with periods in the United States Army Reserve (USAR) in between. He had a break in service and then reenlisted in the USAR on 21 November 1970. On 11 July 1980, he was discharged as a First Sergeant, pay grade E-8, so that he could accept an appointment as a warrant officer. On 12 July 1980, he accepted an appointment as a Reserve warrant officer. The applicant was transferred at his own request to the USAR Individual Ready Reserve (IRR), effective 20 October 1981. He was voluntarily transferred to the Retired Reserve on 11 November 1988. His 60th birthday was 11 December 1999.

The applicant’s military records show that he was commissioned from the Reserve Officer Training Corps as a second lieutenant in the USAR on 8 June 1962, and then in the Regular Army on 17 July 1962. The Transition and Separation Branch, U. S. Army Reserve Personnel Command, responded with a letter dated 26 October 1999, informing the applicant that he did not qualify for retired pay since his last 8 qualifying years were not in a Reserve Component as required by law. In view of his long,...

The applicant requests, in effect, that she be granted entitlement to annuity benefits from the Reserve Component-Survivor Benefit Program (RC-SBP) based upon her deceased husband’s, the former service member (FSM), years of service in the Army National Guard (ARNG) and Army Reserve (USAR). A subsequent Chronological Record of Military Service (ARPC Form 249-3), dated 29 July 1994, indicates only one qualifying year between the retirement year ending (RYE) 30 June 1958 and the 12 August...

A 1989 USAR Standby Advisory Board reviewed his record and selected him for promotion to MAJ. A 1989 Army Board for Correction of Military Records (ABCMR) Proceedings directed that his discharge be voided, that he be promoted to MAJ, that he be credited with qualifying service for Reserve retirement, and that an explanation be placed in his records to show that the resulting gap in Officer Evaluation Reports (OERs) was due to no fault of the officer. On 18 October 1988, ARPERCEN issued...

After having had prior service in various components of the Armed Forces (and serving in the Regular Army from October 1965 – November 1975), he enlisted in the Army National Guard on 21 August 1976. The evidence of record shows it was noted in February 1980 that the applicant needed to serve his last 8 years of qualifying service in a Reserve component prior to being eligible to receive retired pay at age 60. The evidence of record shows the applicant attempted in 1987 to reenlist in the...

This would allow him time to complete all the necessary corrections to his service record and achieve his 20 years of service. The applicant’s military record shows on 27 May 1962, he enlisted in the United States Army Reserve (USAR) for 6 years. Army Regulation 135-180, at paragraph 1-4, states that retired pay is pay granted Reserve component soldiers under Title 10, United States Code, Section 1331, after completion of 20 or more years of qualifying service [a qualifying year requires...

The advisory official stated a review of the applicant's file determined that he completed 19 qualifying years of service as of his RYE 1995. Notwithstanding the recommendation by the advisory official, evidence of record shows that during RYEs 22 June 1987, 22 June 1990, and 22 June 1991, the applicant earned 34, 48, and 47 creditable retirement points, respectively, slightly shy of earning the minimum 50 points necessary to be credited with a qualifying year. As a result, the Board...

ARMY | BCMR | CY2007 | 20070014704
