         BOARD DATE: 22 March 2001
         DOCKET NUMBER: AR2001054103

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

Mr. Carl W. S. Chun Director
Mrs. Joyce A. Hall Analyst

The following members, a quorum, were present:

Ms. Shirley L. Powell Chairperson
Mr. John P. Infante Member
Ms. Regan K. Smith Member

The applicant and counsel if any, did not appear before the Board.

The Board considered the following evidence:

Exhibit A - Application for correction of military
records
Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.

2. The applicant requests that his DD Form 4/3, Enlistment/Reenlistment Document, item 20a be corrected to show that he enlisted for a period of 3 years and 00 weeks.

3. The applicant states in effect, that his enlistment contract erroneously shows he enlisted for 4 years and 00 weeks. The applicant submits a Memorandum for Record signed by the liaison officer, located at the U.S. Army Recruiting Command, Fort Knox, Kentucky which states that his DD Form 4/3 erroneously shows he enlisted for a period of 4 years and 00 weeks instead of 3 years and
00 weeks.

4. The DD Form 4/3 should read 3 years and 00 weeks instead of 4 years and 00 weeks. The applicant’s Statement for Enlistment United States Army Training Enlistment Program DA Form 3286-63 and his Enlistment/Reenlistment Document DD Form 4/1, also erroneously reads 4 years and 00 weeks.

CONCLUSIONS:

There is an administrative error on the applicant’s DD Form 4/1,4/3 and his DA Form 3286-63. The evidence of record shows he enlisted on 9 November 2000 for 3 years and 00 weeks. Therefore, In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That the applicant’s DD Form 4/1, Section B, DD Form 4/3, Section F and DA Form 3286-63, be corrected to show he enlisted for 3 years and 00 weeks.
