         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his DD Form 214 (Report of
Separation from the Armed Forces of the United States) for the period of service 18 October 1948 through 17 October 1951 show that he was awarded the Purple Heart, the Good Conduct Medal, the National Defense Service Medal, and the United Nations Service Medal.

3. The applicant states, in effect, that he was wounded in combat at the Chosin Reservoir in Korea on 28 November 1950 by a gunshot wound to the right arm and shoulder. He provides a copy of his DD Form 214 and a copy of a DA Form 1577 (Authorization of Issuance of Awards), issued on 19 October 1994, showing that he was issued a Purple Heart, the Good Conduct Medal, the National Defense Service Medal, and the United Nations Service Medal. These awards are not listed on his DD Form 214.

4. The applicant’s military records show that he enlisted in the Regular Army on 18 October 1948. He served in the infantry and rose to the rank of corporal on 10 May 1951. He served in Korea and is credited with serving overseas for
2 years, 2 months, and 14 days.

5. A morning report for Company L, 31st Infantry, dated 2 December 1950, made at Hagaru-ri, Korea, shows that the applicant’s duty was changed to absent sick at the 121st Evacuation Hospital, “LD yes BC LWA” (injured in the Line of Duty, Battle Casualty, Lightly Wounded in Action). From a “Hospital Admission Cards Created by the Office of the Surgeon General” report, it shows that applicant was admitted to the hospital on 2 December 1950 with a wound in the shoulder caused by a bullet as a direct result of action against or by an enemy.

6. The applicant was discharged from the service on 17 October 1951 at the expiration of his term of service. He was awarded the Combat Infantryman Badge, the Korean Service Medal with 3 bronze service stars, and the Army of Occupation Medal with Japan clasp.

7. On 19 October 1994, the Army Reserve Personnel Center, St. Louis, Missouri, found the applicant eligible for and issued him the following awards not previously recorded on his DD Form 214: the Purple Heart, the Good Conduct Medal, the National Defense Service Medal, and the United Nations Service Medal.

8. Award of the Purple Heart, according to AR 600-8-22, is made to soldiers wounded, injured, or killed from an outside force or agent as a result of an action against an enemy or an act of any such enemy.




CONCLUSIONS
:

1. The applicant is entitled to the Purple Heart according to the records of his wound to the shoulder by a bullet as a result of an action against an enemy or an act of any such enemy. The Purple Heart should be added to his DD Form 214.

2. The Good Conduct Medal, the National Defense Service Medal, and the United Nations Service Medal should be added to his DD Form 214.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected for the individual concerned by issuing a DD Form 215 (Correction to a DD Form 214) to show that he was awarded the Purple Heart, the Good Conduct Medal, the National Defense Service Medal, and the United Nations Service Medal.
