         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, correction of his DD Form 214 (Report of Transfer or Discharge) to show all awards and decorations to which he is entitled.

3. The applicant states, in effect, that his DD Form 214 does not show all
awards and decorations to which he is entitled. In support of his application
he submits a copy of his DD Form 214.

4. The applicant’s military records show he enlisted on 28 June 1969 as
an indirect fire crewman (11C). He served in Vietnam from 7 December
1969 to 19 June 1970 and was honorably discharged on 20 June 1970.

5. The applicant’s DD Form 214 shows he was awarded the National
Defense Service Medal, the Vietnam Service Medal, and the Vietnam
Campaign Medal. His discharge document does not show any additional awards. Records contain orders confirming award of the Marksmanship Qualification Badge with Rifle and Mortar Bars.

6. The applicant’s DA Form 20 (Enlisted Qualification Record) shows that he
participated in two Campaigns: the Vietnam Winter-Spring 1970 and the DA Sanctuary Counteroffensive.

7. The Board notes that the applicant is entitled to the Vietnam Service Medal with two bronze service stars, which is not shown on his DD Form 214.

8. There are no orders in the applicant’s personnel records, which show that he was awarded the Combat Infantryman Badge. The applicant’s DA Form 20 (Enlisted Qualification Record) shows he served as an indirect fire crewman
(11C) in an armored cavalry unit in combat during his service in Vietnam.

9. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) shows the applicant is entitled to award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation based on Department of the Army General Orders Number 8, dated 1974.

10. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) shows the applicant is entitled to award of the Valorous Unit Award based on Department of the Army General Orders
Number 43, dated 1972.






11. Review of the applicant’s service personnel records does not reveal that
he was recommended for or entitled to any other awards or decorations.

12. Army Regulation 600-8-22 provides, in pertinent part, that the Combat Infantryman Badge is awarded to infantry officers and to enlisted and warrant officers persons who have an infantry MOS. They must have served in active
ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. The Awards Branch of the Total Army Personnel Command has advised, in similar cases, that during the Vietnam era the Combat Infantryman Badge was awarded only to enlisted individuals who held and served in MOS 11B, 11C, 11F, 11G, or 11H.

13. Army Regulation 600-8-22, in pertinent part, authorizes award of a bronze service star, based on qualifying service, for each campaign listed in Appendix B of this regulation and states that authorized bronze service stars will be worn on the appropriate service medal.

CONCLUSIONS:

1. The Board notes that the applicant was awarded the Marksmanship Qualification Badge with Rifle and Mortar Bars. Therefore, he is entitled to correction of his records to show this award.

2. The applicant participated in two campaigns and is entitled to the Vietnam Service Medal with two bronze service stars. Therefore, his records should be
corrected to show that he was awarded the Vietnam Service Medal with two bronze service stars.

3. The evidence of record shows the applicant served as an indirect fire crewman (11C) in an armored cavalry unit in combat while serving in Vietnam. Therefore, he is entitled to correction of his records to show that he was awarded the Combat Infantryman Badge.

4. The Board notes that the applicant was awarded the Republic of Vietnam Gallantry Cross with Palm Unit Citation and the Valorous Unit Award. Therefore,
he is entitled to correction of his records to show these awards.

5. In view of the foregoing, the applicant’s records should be corrected
as recommended below.






RECOMMENDATION:

That all of the Department of the Army records related to this case for the individual concerned be corrected by showing in item 24 (Decorations and Awards) of his DD Form 214 that he was awarded the Marksmanship Qualification Badge with Rifle and Mortar Bars, the Vietnam Service Medal with
two bronze service stars, the Combat Infantryman Badge, the Republic
of Vietnam Gallantry Cross with Palm Unit Citation, and the Valorous Unit
Award.
